No ........... You can't expect a person to pay all their life for something a child did. !!!!! No child could be wicked or evil enough in my opinion !!!!! Get them help and then if they can't function in the real world keep them in a ward somewhere but never Try them as adults !!!!!!! Yes G>W> I see your point but look at you! And Felines. I know the family you are talking about. The mother lived because she was wearing a wig. I just can't imagine a child feeling abandoned by all the adult protectors he has always known to being one over night for something they did that went to far got way to out of hand !!! You just don't know why or what happened !!!! I mean there are all these ""Adults"" out there driving drunk and killing innocent people or just wrecking all the time. They slap them on the wrist and send them on their way straight back to a bar or bottle anyhow !!!! And they do it again and again !!! I'm sorry !! I am a champion of children and will always be !!!!! Do we give up on them and say you're a bad seed, you're out of here like you poopied on the carpet, your going to the Pound? Wirewick!!!!!!!!! Why Are Minors Allowed to be Tried As Adults?

There are probably 2 reasons, minors are tried as adults.

First, say a child grabs one of their parent's guns and shoots a parent and kills them. May be a heat of the moment act while in a rage. In which case, the child would be tried as a juvenile. Which usually means, they could get prison time - but once they are 18 (or in some states 21), they might be released and their criminal records are sealed.

Or say a child buys a gun and practices using it before killing their parents. This is a premeditated act and a deliberate act. They would be tried as an adult. And if convicted may either get the death sentence or time in a prison with adults. If in a prison with adults, the adults would pick on the juvenile and sexually abuse them. If eventually released from prison, the act is on their public criminal record.

What crimes triggers the adults trail varies from state to state. And another factor may be the public outcry over the criminal act.

Second, people have become upset over the increase in crimial acts perfomed by kids. Just like in the 1990's people were upset with repeat adult offenders and passed a 3-strikes and you are out (if you are convicted of 3 serious crimes during your life, you get life in prison without the possbility of ever getting out), people have demanded trying more kids as adults where they may get tougher sentences for their criminal acts. In some places, people are now wondering - did we go too far on this and there may be talk of reducing some "try as adult" cases.

In Virginia, state authorities monitor how many kids under 18 are serving time in the adult prisons. And in some cases, corrections officials try to put the kids in places (prison buildings) where they might be safer than being around the average adult inmate population. But its really really hard to protect a prisoner 24 hours per day, 7 days per week, for years.

At one time, gangs were recruiting juveniles as gang members to kill people because they knew the system would treat them as juveniles and they would get out when they turned 18.

Is it right for minors to ever be charged as adults?

Why do minors not receive the same rights adults do in America?

Minors are considered to be immature and incapable of fully anticipating the practical or moral consequences of their actions. Some of their rights are curtailed and/or delegated to their parents to prevent the minors from causing harm to themselves or others.

First, I'd like to say that while I disagree with your stance, that I respect you as a person - spelling errors and typos and all. I think it's immature to base one's opinion of a person on such inconsequential things. Paying attention to what is said is far more important and while your arguments are phenomenal, they're not bad either. They are reasonable. I have seen much dumber things stated by people with better punctuation. I'd rather answer your question ;)

I don't think these laws are about underestimating the minor at all, actually. I think they are more about underestimating the adult ;)

I have a friend, brilliantly intelligent, who went off to college and had never had a boyfriend, never been kissed and was just all around socially awkward. She met a guy online and they agreed to have a no-strings-attached sexual relationship because she -said- she was ready...and she really believed she could handle it.

She couldn't, as predicted, and she's terribly emotionally scarred now because of it.

She wasn't a minor at the time, but she was a minor mentally. And HE should have realized that.

The inexperienced tend to overestimate what they can handle emotionally - it's a challenge to their ego. And that's a good thing - if they didn't try to rise up to every challenge that came their way, they'd end up not knowing what they were really capable of later in life.

In the case of adults having sex with minors, the adult is expected to guide the younger person and look out for the younger person and stand up to the younger person when it is apparent that the younger person is wrong. The adult has been there and should know that at younger ages one thinks oneself invincible and capable of anything...

I don't know if I'm making sense, unfortunately. It amounts to this: The laws are there to protect the minors from the adults who would use them and toss them away, not to repress minors or love. Love does not require sex. Love requires respect for one another...and the older person in a relationship (any relationship where one person is significantly older than the other) has a further responsibility to protect their younger partner, whether sexual or not.

Should juveniles be tried as adults?

In a nutshell...yes. If they are above the age of 15 and KNOW what they either did or are accused of, then yes. There are so many factors that the legal system has to look at and evaluate prior to charging a minor as an adult. Mainly intent.

Should a 16 year old be tried as an adult for manslaughter if they were drinking and driving and "accidently" killed someone in a car accident? Yep!! Should the punishment be light?? Yep! Why?? For my own reasons.

But let the Judges decide the level of punishment. That is why we elect them into office. But not to many people really pay attention who is running for such an important office now do they? Tough job! I wouldn't want it.

Why shouldn't juvenile adolescents be trialed as adults?

I’m not too sure on the whole legal/child psychology reasoning.But for me, the first thing I think of is a 13 year old in being out through the same processes as 23 year old. At that age they’re still so young and impressionable, and quite honestly, I think, depending on the severity of the crime they’re convicted of, they should be treated more carefully. This is because young adolescents are still forming their opinion on the world, and if the world isn’t good to them, they’re going to take it back out on the world.Often what younger offenders may be looking for is a bit of attention. Maybe it is a cry for help. By giving them a second chance and helping them to have more trust in themselves, these younger people may be given that small piece of faith they need, and they don’t repeat offend.On the other hand though, it could work the other way. If someone gets away with something once. Or are treated leniently. They may do it again. And again. Again, this may partially be due to some attention seeking. But still, no one should get away with being a danger to society.This is rather a ramble answer, but what I’m trying to say is, look after the younger kids. They are the future. And they are still deciding how they’re going to be the future. By treating them slightly more leniently, and helping them to realise what is and isn’t acceptable, they might make for a better future.

Juvenile offenders are NOT adults?? Why treat them as such??

This is america are you kidding the so called freedom we have does no exist during some point and time in history they managed to pull a vail over our heads to makes us think we have freedom when in truth that's the furthest thing from what we have. You want to talk about numbers and ages how about this at 18 your a so called adult you can die for your country yet you can't drink, gamble and in some areas it's illegal to look at porn if your under 21. This is america ever heard of the patriot act? we have no privacy anything the goverment wants they take. I believe it's in china not sure but I think china a cop can pull you over and get your information and go through your e-mails were not far behind china in this they'll intorduce it as a way to fight terrorism but that's the furthest from the truth. This is america the goverment does what they want when they want.
