My car is totaled, not my fault, guys insurance won't pay. What to do with car.?

My parked car was recently hit by the 15 year old driver, who was not carrying a permit, whose grandfather was trying to teach her to drive.After getting his info I contacted his insurance company who sent me a letter stating that because the driver of the vehicle was the granddaughter and not her grandfather they aren't liable to pay for anything.After taking the car to a few collision specialist all have stated that my car is totaled. Although it was drivable, my 1994 nissan Altima (58,000 miles) sustained, according to my lowest estimate $2,290 worth of damage. The car in good condition off of Kelly blue book is worth #2,375 if i sold it on my own. Because my car didn't have collision my insurance company won't help so I'm left to settle this my self. After discussion with my parents and the mechanic( and one AAA guy) they believe it's not worth fixing and I should look for a new car. My question then becomes if i sue the individual( who believed it would only be a few hundred dollars) what is to become of my car now. Usually an insurance company would write me a check and take the car but because none will be involved if i sue for the value of the car so i can purchase another vehicle i'm i legally obligated to sell the car now to a scrap yard or body shop and deduct that from the value. What if I want to keep the vehicle and use the money to fix it to purchase another?

You don't have to accept the first offer the insurance company makes. They will low ball you. You can try to make the case with the adjuster that the car is worth more, say retail value instead of trade-in value. Maybe the car had low miles, maybe it has a new engine, maybe whatever. Negotiate with the insurance company, stick to your guns and see what happens. If the final offer is still too low, then you can hire a lawyer to talk to them, adding her fees to the total, of course. Suing is the final venue, but since there were no injuries to you or your passengers, the car is the only thing that you are concerned about.

You don't really sue the person who's car hit you, you sue their insurance company and you are looking for the money from them. Most of the time, the person who hit you doesn't have any money and because their car was likely totaled are in the same spot as you.

Same thing happen to me... guy turned left into on-coming traffic, totaledmy car. I only had liability. His insurance said my car was worth 1100, probably would have been had i not put a new transmission in it 3 weeks earlier. Sued him.. got 2300. Not much.. but more than i paid for the car.
But you don't need a lawyer I didn't have one. Im 19. Get accident reports, conditions, anything you can think of. My car was dark blue and it was noon. The guy said he ddidn'tsee me or hear my horn. I showed a layout of the intersection complete with speed limits on both sides. Basically, tell the truth and know what you are talking about. You'll have no problems.

I'm not sure about susuinghe company, but by suing him, the car is under their insurance, so... I think they get it too.

Rear ended car was totaled.. Sue? How much $ will I get?

My girls car was rear ended at a complete stop by an 85 yr old woman who was handicapped. She hit us once and then another time because her foot was "stuck" on the gas pedal. Should we sue her? First, you are only 17 so you cannot sue. Your parents would have to file. It is sad at your young age you have already become litigious.

Why are you thinking about suing anyway. Have your parents called the other parties insurance company to advise you were injured? What have they said/done? Have they attempt to resolve the claim with them?

Just because you may have been injured does not mean you are entitled to any monetary compensation. The tort threshold requirements vary from state to state. Some are verbal, others are monetary and in some your injury must be serious. From what you describe your injury is not serious. What state did this loss occur in?

You claim you are suffering from PTSD. Do you have any medical documentation in support of this allegation? If not, don't expect any compensation.

She should be sued AND she should be charged for involuntary manslaughter. One is a civil proceeding. One is a criminal proceeding. She needs to deal with both. You can't just run into the back of somebody's car stopped in traffic and kill them. You have to be aware and know what you're doing when you're driving so you don't end up taking an innocent life. If you do take an innocent life, then that's involuntary manslaughter. As for a civil suit. If someone just comes out of nowhere and slams into the back of your car and kills you, then your family have the right to be compensated for losing you. So she must pay for that as well. And if it's proven she was 'neglegent' in any way (such as talking on a cell phone) then she'll have to pay 'punative damages' which could run into the millions. Life for her would be so much easier had she just been paying attention to her driving that day. It's very sad.

I''s a lot easier to collect from your own insurance carrier if you have uninsured motorist coverage; guess you don't or you would not be asking this question.
Also, some states have special restitution programs for victims of uninsured/underinsured motorists.
The program may or may not be restricted to those who were physically injured.
