Would Collections Call Me If Someone Applied For A Mortgage Loan In My Name

Debt collection agency (Capital Management) refuses to stop calling me. What can I do?

This horrible company called "Capital Management Services, L.P." [http://www.cms-collect.com/] continually calls and tells me that I owe them some debt. It's incorrect and I tell them that.

They are very, very rude. So about 6 months ago I told them to stop calling me. But they keep calling. Different people (all with strong Indian accents, yet amazingly American names like Sally and Bob) call each time. I always say, "I told you to stop calling me..." and they reply with some garbage like "I have never called you before. What is your name? You need to give me your name right now. Give me your name".

Obviously I refuse, and they say more rude comments and hang up. I have no luck when calling them and their phone is routed nowhere. The company appears to be in NY, USA! How is this legal??

My question is, how can I get this to stop permanently? I've seen many other reports too. I want to take action and get this stopped ASAP and hopefully get them in trouble as they deserve.

How can I write a letter to a bank manager to collect original documents of a house after closing the mortgage loan?

Credit collections with wells fargo bank?

Remember that those representative in the collections department work on commission, and that is why she said she wouldn't take less...because she gets PAID on less.

I used to work for Wells Fargo early in my career, and what I can tell you, is that what the woman told you borderlined a threat, which is illegal.

Send them $20, $10, $5, anything you can per month...even if it's a $1, it's better than not sending anything at all. Even if they say they won't take it, put it in the mail and send it anyway...and send everything CERTIFIED and keep every single cancelled check like they were made of gold. Keep detailed records of your balance and what is remaining.

Don't worry about paying by personal check, if you have ever paid them before by check, they have a copy of this information anyway, and can't do anything without a court order, of which you would receive notice of. (And it is EXTREMELY unlikely they will go that route).

Since it is a credt card, the worst thing they will do is ding your credit, but you need to focus on finding a job, paying for a place to live, gas in your car, and food on the table before paying off a credit card...but still, do what you can.

Instead of taking calls from them, send them a certified letter spelling out what you are able to pay per month, don't take anymore calls from them, and send them what you can.

I wouldn't speak to them either if they aren't willing to negotiate, and do what I consider, is very rude.

PS: Remember what they can legally do, and what they will do is two different things. The worst Wells Fargo will do is get a judgement against you and it only appears on your credit report. Just pay it when you can.

Is this considered harassment by collection dept of mortgage company?

We are behind on the mortgage by a month and a half. We owe one complete payment, and half of another. My husband was unemployed for 9 months, and recently found a job. Of course this job only makes 40% of what his former job made. Yes we are financially hurting. On top of that we were burglarized last month. Nothing like getting kicked when you are down. We haven't received the insurance check yet.

My husband spoke with the collections dept, and told them they would get a payment on Friday. That is when he gets paid. That call was at 2:30 in the afternoon. They preceded to call 5 more times until 7 pm. They just called for the first time today. They are leaving nasty messages. It is not uncommon for them to call 10x in a day. I mean "DUH, I didn't have the money this morning at 9:30, but you know, try back in an hour, and I just might have it."

Is this harassment?

A debt collector is claiming I owe money to washington mutual bank and is collecting for them. ?

Tell them to send you a letter in official letterhead but don't provide your address or other info since they should have this information if they are really collecting for WaMu. Ask them how much you owe and other info that only you would know such as what kind of debt is it (car loan, line of credit, etc), just make sure they don't turn around the questions and get this info from you first. Collection agencies are very sneaky and very good at what they do, so watch out.

If you owe money to WaMu like a mortgage or car loan, you should continue making payments as usual until you get a letter on company letterhead instructing you to pay someone else, in this case JP Morgan. Or better yet, if your branch is still open, get there and talk to their service reps.

If you debt was already in collection mode, then it's possible, but you should still follow my first suggestion, or again, head to your branch and get some answers in person.

Sounds like someone is trying to pull a scam on wamu customers since most are just as confused as you.

Mistake #1 was talking to the collector on the phone. Not only was everything she told you a lie, but if you could prove what she said you could have filed a $1000 lawsuit against her.

It's very, very important to get everything in writing. Remember, you can NEVER believe a collection agent. They will lie to their mothers if the think they can collect money that way!

Send this collection agent a certified letter. In it, demand that they completely validate this debt, and do not call you again. make them send everything in writing.

Online Payday loans. I closed my account...what will happen now?

Someone I work with was in a similar situation and closed her checking account as well. They have harassed her - this was about 2 months ago and as far as I know they haven't done anything else. She was actually advised by a debt consolidator to let them default ... the thinking being if they are sucking every dime out of you and you can't pay your rent, car payment, etc. you are not getting ahead and debt consolidation companies can't help you with the payday loans until they go into collection. Payday loans are illegal in some states. I would 1) check with your state attorney general's office to see if they are legal in your state and whether you have any recourse (the fees/interest they charge is absolutely ridiculous - even relief from that would be helpful) 2) call legal aide 3) if you can't work out an arrangement with them and your situation warrants it call a debt consolidation company one of the reputable ones (check your state's attorney general's office for recommendations) and 4) never ever take out a payday or title loan again. :)

Oh by the way, I'm not an attorney or anything but I do not believe you've committed fraud. Fraud would be if you took out the loans under someone else's name. You've defaulted on a loan and yes they can pursue collection activity and take you to civil small claims court. But they can't sue you for fraud.

If by misfortune you defaulted on payment for loans of NBFC then get ready for lifetime exp. They will make sure you see the collection guys every where. Outside your home, outside your office ,... Etc. Some times you can also expect people fishing you on social media.If you are able to cross 90 days time of default then your case is given to a specialised agencies who can do anything to get money back. Banks normally refrain from using muscle power these days. They use social pressure, phycological pressures to get money back.If some body is real notorious to be able to deal with all this, banks can't do anything apart from sending court notice under section 58 of negotiable instrument act .once you come under 58 section, it's is really difficult to get away. It's a punishable offence.So please pay EMI on time. Don't take loan if cant pay.
