There are too reasons you could get in trouble. The first is by claiming the goods are authentic. That is fraud against the buyer. You can avoid that charge buy CLEARLY stating in the auction that you are selling fakes. The second applies if what you are faking is protected under a trademark, etc. If you sell fake brand name merchandise, the owner of the brand can sue.

There are certain movies and albums that are watched by ISP content filters with an eagle eye. For example, if you downloaded The Dark Knight Rises or the newest Justin Bieber album, your chances of getting caught are astronomically higher than if you downloaded One Flew Over the Cuckoo's Nest or a Beatles album.
