What is a two party check?

A two party check is a check made payable to two people. The idea is that both people are entitled to a portion or all of the funds each and need to sort out the division of this before they endorse the check to receive payment. You don’t get to deposit this check in the bank normally without that second signture.The usage I am most familiar with is in payment for lawsuit settlements. The paying party will usually make payment to the plaintiff AND his attorney. This is because most such things the fees are contingent on results, and the attorneys will need to be paid before you get anything. What you do is endorse the check and cart it over to the attorney’s office, who will take the check, issue one of their own checks for your share of the settlement, then endorse the 2-party check and deposit it in their client trust account.

Usually there are two parties on a check.  1.  The person writing the check or account holder.  2.  The person the check is written to or payee.  It becomes a third party check when another person or entity tries to negotiate this check on behalf of the payee.  For example, I try and deposit my sister's payroll check into my checking account.  I am the third party in possession of the check and when it's deposited into my account it is considered a third party check.  Many financial institutions will NOT negotiate third party checks.   Another more wide stream example would be check cashers.  When you take your payroll check to cash it at a check casher or some liquor stores, the store gives you cash and then deposits your check into their account.  The check cashing entity becomes the third party negotiating that check.  These are considered third party negotiators.  They usually have to have a special agreement on file with a bank to deposit these items.  These businesses are also considered high risk and are MSBs or money services businesses.   They are closely monitored and regulated by the government and homeland sercurity.  Look up bank secrecy act or BSA.

How do I verify a third party check?

The best policy is, if you have any doubt about a third party check, don’t take it. On the teller line we verify third party checks by requiring both parties to be present with an ID at the time of deposit, and then having the initial payee endorse the check over to the third party who’s account the check will go into. Third party checks should never be cashed.

Does Walmart cash 3rd party checks?

How can I cash a two-party check if spouse is in jail?

unfortunately, he would HAVE to sign it (or you would have to commit forgery) to deposit the check. what you might want to think about doing is getting "power of attorney" on his accounts while he is in jail. this would give you the legal right to perform all matters of finance involving his name while he is in jail. this can be a long process, but depending on how many instances like this you will have it may be rewarding to do so. otherwise, you would just have to mail the check to him or go visit him and have him sign it. sorry to be the bearer of bad news =(
