A Power of Attorney is an appointed person over your affairs, of YOUR CHOOSING, this means the POA can make decisions on your behalf, if your unable to.

However to be a POA the person appointing a POA must understand what the implications of having a POA.

There are different types of POA's, each having clear guidelines on what the POA can or cannot do, that includes spending or taking the persons money, without good reason, sadly there are people who do abuse this, and that of the rights of the person they are supposed to protect and support.

Most POA's etc do require the POA to submit a financial report etc every year, to ensure that the POA is not being greedy.

Do you have to have your middle name on a power of attorney form?

You do not have to, I mean the document should be legal and work but it's better to have it. Like the other answer says if someone questions it. True. I add, you would have to prove that you are the described person in the document.

Another very important thing is to have the same name print and signature when dealing with paperwork, in this case you should not use a middle name or else you may have to repeat and re-sign all paperwork because your power of attorney does not have a middle name.

A power of attorney is a letter that limited the amount of transaction done by a person appointed by you. You can download this form from the internet. The most important thing is to get it notarized. Any bank, hospital or institution will recognized this letter.

There are two types of POAs, health care POAs and financial (durable) POAs. It's OK to use a free health care POA as long as it's for your own state of residence.

The reason health care POAs are free is because each state's legislature has written language that will make a POA legal in that state; it's in the law, so the free sites just copy from the law books. The reason financial POAs aren't free is because most states haven't written language into law because "everyone's situation is different" (which it may be) and they want you to see a lawyer to be sure you know what you're doing.

For the financial POAs, at least use an inexpensive online one (again, state-specific) from nolo.com, Quicken Willmaker. They aren't very expensive and have been around for a very long time. Do some research to be sure you understand what they are asking you and what a POA can and cannot do. As long as you have a state-specific form, you don't need an atty unless your situation is really complicated. But be SURE you understand all the terminology, because a POA is a very powerful document that lets someone else handle your money and assets!

If you have a lawyer draw up your will, they will usually do a POA for little or nothing. Also, you can always have a lawyer read over and examine your POA before signing it; find someone who won't charge much for this "peace of mind".
