How to get permission from Nintendo to use their Pokemon music?

I want to use it. Should I ask Nintendo/ Pokemon or the author of the remix (it's a remix) for permission, or both?
R4 on the Nintendo DS?
Technically the R4 is not illegal, but downloading any copyrighted games without explicit written consent from the game companys IS illegal. But the games companies can't really do anything about it. For older games, it's not a big deal at all (Pokemon Red/Blue) because nintendo isn't getting revenue anymore at all from those games. If you download copyrighted material without permission, it is illegal. BUT just using it for things like music or other media is fine. ...and like they say: "nothing is illegal, unless you get caught".
