If a contractor screws up can he ask for more money to finish the job?

If a contractor states a price, messes up the tile, beam braces, etc. and uses all the money put in, can he ask for more money to finish the job? Or can he just stop working instead of digging into his own pockets?

I guess my main question is, if he quotes say, 45 grand for a job, and his guys screw up some expensive part, is he contractually bound to abide by the agreed price?

A W2 worker or a 1099 contractor? Am I being screwed?

I am in a very confusing situation.

I have been working for a guy who seems to be a contractor.

I am working WITH a commercial moving company. I wear the company uniform but I'm not directly on payroll as an employee.

I'm assuming the guy who hired me has a contract with said company.

I have work for this guy for 2 weeks now making a measley $10/ hr at 40 hours a week.

I have gotten paid by personal check from a business account.

I admit, I havent attempted to ask him probing questions for fear of losing this job.

I do know that I will get a 1099 but I haven't signed anything.

He has a copy of my SS card and state ID.

How bad am i going to be screwed at the end of the year?

When I report my earnings next year which will be a little over 12k how much will o owe?

Also what would be the consequences if don't do Self employment tax and do only income tax?

good just have him sign the paper that he will be done by that time and give him the $6K that way you will end up owing him less by the time he's done. but you my friend the bill of rights in amendment 4,5,6, or 7 states that if someone is not done or he just doesn't show up you can sew him by all the money you payed him and he didn't finish your job. but just gibe him time and if you actually see him working hard at least 5 days a week you could be pretty sure he will be done by the second deadline.

My contractor screwed me and now wants his tools back?

I paid a contractor over 10000 to do some remodeling , I have found him smoking weed drinking and never shows up...I paid him all of the money but the job is not complete I fired him and he left tools but now wants them back. he owes me 3000 or more what do I do

BAD PAINT JOB ON HOUSE. CONTRACTOR threatening to sue us!!?

Legally he breeched the contract already-- The job was not completed on august 9th. HE should refund you the money you already paid him and hire someone else. He can NOT sue you for hiring someone else because the contract gave HIM a deadline that was not met. Let the guy rant and rave, call a police officer to your house, show him (or her) the contract, and get the officer to see that the job is not completed, and get the officer to document this on the report. Then you call in another painter, and go down to the courthouse to file a claim against the painter to recover the initial payment. If you can, take pictures of the paint runs, inconsistent coloring, and the wood that was left exposed. If the guy DOES try to sue, just take the DOCUMENTED police report and pictures along with the contract to the courthouse, the judge will see the "job to be completed by..." date on the contract, the date of the police report (which will be a month after the job was supposed to be done), and PICTURES that will prove that the job was not done. The judge will then most likely order the plaintiff to pay you back the deposit you paid. You could possibly even counter sue for damages.

My contractor isn't answering my calls & he hasn't worked on our house in over 2 weeks. What are my rights?

We are having an addition put on the back of our house (720 sq. ft). Our contractor said he underbid the job and he is having to take about $20,000 out of his pocket to finish the job. We have a written contract that states the total amount and estimated time for completion. I have called him and left messages, but he hasn't called me back. I am half tempted to go to his home and see what is going on. I am very angry and confused. He has enough money to cover the whole project...all we have to pay is his profit when the job is complete. What are my rights? What should I do? There are only 35 more days left until the estimated time is up for the job. Should I get an attorney? We have a covered structure with 2 x 4's and wall partitions, and tyvek plastic on the outside. We are waiting on shingling the roof, electrical, insulation and drywall, cabinets, flooring. I am so lost. Somebody please help!!!!

A contractor really messes up job, you refuse pay, what are his legal options?

It depends on what state you're in. I'm a GC in NC and we have a certain amount of time to file a lien, which is what the contractor would have to collect any unpaid monies. He would have to put a lien on your house and then you would go to court for a hearing. GREAT job on taking pics. Make sure you keep a record of EVERYTHING and get a statement from the contractor you decide to go with next specifying all of the work including the "demolition" of the other contractor. It is extremely important that you use a licensed contractor if necessary (your state determines that depending on the amount of the job). You do not have to accept a poor job and should defend yourself against crooks calling themselves contractors. Good luck and make sure you get at least 3 references any time you hire someone to work on your property. One more thing... It doesn't matter if you had a contract if the contractor did not do the work as specified. If he didn't do the job as proposed, he breached his contract and you may have a counter-suit for the demolition.
