Whose Rights Are Greater Ours Or Our Employers

In India, is there a limit on the number of hours per week an employer can make an employee work? What do the labour laws say?

Working Hours in India: As per theFactories Act 1948, every adult (a person who has completed 18 years of age) cannot work for more than 48hours in a week and not more than 9hours in a day. According to Section 51 of the Act, the spread over should not exceed 10-1/2 hours.According to ILO Conventions 1 and 30, the standard or normal working hours should not exceed forty-eight hours in a week and eight hours in a day. Convention 01 is applicable to the industrial undertakings which include among others mines, quarries and other processes for extractions of minerals, construction, maintenance and repair of buildings, railways, telephone installations, gas works, transport services, etc. On the other hand, Convention 30 covers those employees, which are engaged in commerce sector and administrative activities/office work. (Plus 30min of break in India)Sec. 14 of the Act mentions that any worker whose minimum rate of wages are fixed with wage period of time, such as by hour, by the day or by any such period and if a worker works more than that number of hours, it is considered to be overtime. In case if the number of hours constituting a normal working day exceeds the given limit, then the employer will have to pay him for every hour or for part of an hour for which he has worked in excess at the overtime rate.According to Rule 25 of Minimum Wages (Central) Rules, 1950 also states that overtime is to be given at double the ordinary rate of wages. According to the Minimum Wages Act & Rules we are to divide the rate of wages by 26 for calculating 8 hours (one day) wages. For calculating one hr. wages we are to divide by 8 to one day wages. Thus if we take overtime for one hour then we are to paid wages at double this wages for one hour. State Shops & commercial Establishment Acts also provides provisions for overtime payments. You may go through these enactments for having more clarification on the subject.• As per the Act it is compulsory to maintain registers and records as Register of Overtime –Form IV. This Register of Overtime contains various details such as name of employee, hours of overtime, date and other such details which are necessary for the records.• Contravention of any provisions pertaining to fixing hours for normal working day etc., will be punishable with imprisonment upto 6 months or with fine upto Rs.500.

How do I answer the question "Why do you want to leave your current company," when I think my current employer is struggling in a small industry and want to ensure that my answer does not come off as an outright criticism of it?

Personally , the interviewer obviously knows. However, some things I have found are useful1. My current company was a great place to start my career, got to learn a lot, now I think I have what it takes to move to a smaller company , take more responsibility, drive bigger things. My current company is a little too big, and probably won't give me that much of opportunity2. I feel that I have mastered what I have doing and with the tech market moving fast, I think it is better to be active, work with younger people and check out what's going on. A new job gives me an opportunity to deep dive into something new, something challenging3. It obviously makes sense to take advantage of this question to praise the company (esp if you are speaking to a startup co-founder). eg. xxx is a great product that even I use, and I have some ideas for it, and I would love to see them go live.I think money is an implicit answer, but i would not say no, if asked if it was about the money . Or you can say "Well, money's not the driver for this decision, but obviously, I would like to work hard and earn some more money if given an opportunity". Speaking about the culture of the old company , is a careful thing. You have to make sure that you don't screw your own image . For example I interviewed a guy who said " I have worked really hard so far, I want to join a big company so that I can get into a 9-5 routine and take care of my kids "
