Why are penalties for DUI related accidents handled so lax in the US? Drivers with multiple offense are still on the road.

Annett, Thank you for asking me to answer this question. I wish I knew the history of why penalties were so low for impaired/intoxicated drivers. My law firm does not handle any criminal law cases. At the Blackwell Law Firm we specialize in injury and damage claims. We help people injured in car accidents. So, we often see the tragic results of impaired/intoxicated driving.Why are DUI penalties so low? I think it is multi-factorial. For one, our culture often lacks alternate transportation. Another person who answered the question hit on this issue. Most American communities lack mass transit options. Yet, most people also live too far to walk. As the prior responder Loring noted, people judging any set of facts will ask themselves if they could be in the same situation. Here, cars are typically required for travel between home, work and other activities. So, many people (including judges, jurors, etc.) will see themselves in that scenario. Add to the lack of mass transit, other factors including the way our culture loves its cars and loves its personal independence.It’s a separate issue but in many jurisdictions, the law is more favorable to car drivers than pedestrians in situations where a car strikes a pedestrian. And, even when those cases go to trial, juries often favor the car driver over the pedestrian. This is especially true in jurisdictions that lack a major pedestrian city. Why? For the same reasons as above. Specifically, in these areas with lots of car traffic and little pedestrian activity, many drivers can picture themselves accidentally striking a pedestrian. They fear themselves being in trouble for it. So, the laws and penalties are very limited.

Alternative modes of transportation for DUI offenders?

so my boyfriend got a DUI last year and i was wondering what alternate modes of transportation would be. I got him a bike in the summer but after a couple weeks a sharp thorn punctured a tire and he never fixed it. I am flipping sick and tiered of driving him to and from work every. single. day. and im wondering what his other options would be. we only live about a mile away from his work and trust me i have flipped a ***** over and over about this but he still expects a ride from me every day.

REHABILITATION or RETRIBUTION in prison?

I actually think that being in prison without getting education is pointless. Why should these people live according to a prison system which is based on revenge? They are humans and they should be treated us ones. I believe that we should all understand that prisoners' lives don't "pause" while they 're in prison. They just change. One thing that we should be aware of (and fight for it) is that they change in a direction which guarantees peace and respect for everyone.

How does getting a parking ticket affect your driving record and your insurance premiums?

Most of the times, it is only Driving Violations like speeding, tailgating, wreck less operation, DUI or DWI and rash of accidents that are your fault that really effect your insurance.  Exceptions might be due how hard it is or it is not to get a parking space and the amount and or frequency of your tickets. Usually, even with those that are newly insured, they have no rise policy for those that experience an accident now and then.  If your parking tickets are now and then and you have a generally good relationship with your agent, parking tickets would not be detrimental.

Was my case dropped if I got an "Order of set aside or reinstatement" of my license in CA after DUI?

Hi everyone, I was pulled over and arrested last month for a DUI in San Francisco. The chp officer said I blew a .09 and later at the jail I did the blood test. An "Order of set aside or reinstatement" letter arrived yesterday and it states that I can apply for a duplicate license at a dmv office. I have never been arrested before and nobody was hurt the night I was arrested. Does this mean during the dmv hearing they came to the conclusion to not suspend my license?

I have to go to court later this month and I understand that the court may decide to take my DL away from me. Are the chances of getting it dropped or even down from a dui to a wet wreckless good since the dmv decided not suspend my driving privileges? I'm currently a college student studying business and do not have extra money to hire a lawyer and hope I will qualify for a public defender.
