Here's it:
5 January 2009

Mr Santa Claus,
Santa’s Christmas Company
011 Santa’s Lair
North Pole, Reindeer County

PO BOX 1000

Dear Mr Claus

I am writing to express my sadness and disappointment at the quality of your service on the 24th of December 2008, that is in the day I received a gift from you that I found under a Christmas tree in my house.

Unfortunately, your service has not performed well because I have been given items that I did not wish or request. I am disappointed because this year I asked for one of the Topshop evening dresses designed by Kate Moss from Autumn/Winter 2008 collection and earrings that I could match to it but got nothing that I ordered. In addition, there were no paper and the ribbon and I found my present in an ugly plastic bag. To make matters worse, I have sent several letters to your manager, Mr Rudolph for a refund or exchange but have not got any replies so far.

As you can imagine I am extremely upset and disappointed about the whole experience. To resolve the problem, I would appreciate it if you could exchange the gift so that I could receive a dress that I am longing for and wear it at the end of January at a ball organized by my school.

I’m looking forward to your reply and the resolution to my problem, and will wait until 15th of January 2009 before losing all my love and hope in you. Please contact me at the above address.

Yours Sincerely,

Marta, an unhappy customer

How do you handle a company refusing or ignoring a refund request within the refund period?

If you paid via credit card, you can force a refund if it's legitimate. This is called a chargeback. To begin the chargeback process, you'll usually contact your bank. Sometimes they have ways to initiate the chargeback online. In either event, they are going to ask you questions like:"When was the charge created?""Did you ask for a refund from the merchant? Can you provide documentation to show that you asked for a refund?""Why are you asking for a refund?"And probably a few others. The questions are asked to make sure that this isn't some form of friendly fraud or that your refund is illegitimate. It costs the banks time and money to go through this process, so they want to make sure they are defending you for the right reasons. From there, a chargeback dispute is soon after issued against the merchant. They receive a penalty fee (somewhere in the $5-$30 range) and have the total amount that you are disputing deducted from their bank account or incoming processing volume. They have some amount of days to show why your dispute is wrong. They will work on this with their processor. Many merchants don't bother to fight a chargeback. Some have a third party company do it for them. However, much to the chagrin of merchants everywhere, chargebacks tend to favor the cardholder by default. So all things being equal, you will receive your refund. The time frames for each of these steps vary depending on your bank, the processor and the merchant's response time. But you should see your funds back on your card shortly.

How reliable is the Better Business Bureau's report on a business?

The BBB isn't the "Business Police." The BBB collects reports on companies from consumers. Just because a business has a good report doesn't mean they are necessarily a perfect company - it just means the BBB hasn't received any complaints on them or complaints have been resolved.

The purpose of the BBB system is not to act as an advocate for businesses or consumers, but to act as a mutually trusted intermediary to resolve disputes, to facilitate communication, and to provide information on ethical business practices.

When a BBB receives a complaint, they present the complaint to the business and request its assistance in working out the problem with the unhappy customer. Most companies are grateful for the opportunity to resolve problems with their customers since it often means their patronage will be preserved.

BBB members agree to respond to consumer complaints presented by the BBB, and lose their membership if they do not. Most other companies, regardless of whether they are BBB members, also cooperate with the BBB.

However, some companies do not want to work with the Bureau and/or their customers to resolve complaints.Because the BBB is not a government or law enforcement agency, the Bureau cannot force a reply from a company; nor can it administer sanctions. However, a company's unwillingness to respond to the BBB or a customer will be noted in the company's reliability report the BBB provides to the public. The customer is free to pursue other alternatives such as legal action.

BBBs can help solve consumer/business problems. As private non-profit organizations, however, they cannot force a solution on parties to a dispute. Most BBBs do offer mediation and arbitration to help resolve consumer disputes, which can save both businesses and consumers the time and expense of going to court.
