Why was the new deal unconstitutional?

Actually, only certains parts of the New Deal were determined by the Supreme Court to be unconstitutional. Be sure to make that clear in your essay.

One part that was determined unconstitutional was the NRA.

Other parts, such as the WPA were fine.

The National Recovery Administration (NRA) was the primary New Deal agency established by U.S. president Franklin D. Roosevelt (FDR) in 1933. The goal was to eliminate "cut-throat competition" by bringing industry, labor and government together to create codes of "fair practices" and set prices. The NRA was created by the National Industrial Recovery Act (NIRA) and allowed industries to get together and write "codes of fair competition." The codes were intended to reduce "destructive competition" and to help workers by setting minimum wages and maximum weekly hours, as well as minimum prices at which products could be sold. The NRA also had a two year renewal charter and was set to expire in June 1935 if not renewed.

In 1935, the U.S. Supreme Court unanimously declared that the NRA law was unconstitutional, ruling that it infringed the separation of powers under the United States Constitution. The NRA quickly stopped operations, but many of its labor provisions reappeared in the National Labor Relations Act (Wagner Act), passed later the same year. The long-term result was a surge in the growth and power of unions, which became a core of the New Deal Coalition that dominated national politics for the next three decades.

Do conservatives still support Reagan's goal of expanded state's rights?

Reagan’s “goal” was not “States' rights”. The goal was to dismantle the Federal Government so that the Corporations would find it easier to control our country. “State’s rights” is a dog-whistle phrase for cutting funding from the Federal Government that benefited the states.There are many examples of this policy of cutting funding on the Federal level being implemented, and then creating massive hardship on the state level. He called this gutting of our social programs “restoring power to the state level”.It is a play on words that means, “We are cutting taxes for the wealthy. To make up for that lost revenue, we are going to eliminate Federal assistance at the State level. Eliminating Federal assistance puts the States in control of their own programs for their own citizens”. Which is analogous to saying “you’re on your own as far as the welfare of your citizens go. The Federal Government will no longer help you with your citizens who are mentally ill, in poverty, in need of health care, and so on.

Why shouldn't minimum wage be raised?

Off the top of my head....

1.) This will lead to a commensurate increase in prices, devaluing the dollar.
2.) This will devalue the salaries of people who are already being paid over the minimum wage (say it with me: penalizing success).
3.) The minimum wage is not intended to be what a family should live on; but rather, what people newly entering the job market should start at. If you continue making minimum wage all your life, then you are doing something wrong.

Cons, how could you even stop Outsourcing?

The only way to stop outsourcing through the Free Market is to destroy the minimum wage and allow US citizens to get paid the way Chinese citizens do. Even if we simply get rid of unions, they won't keep the jobs here if they can make the Chinese do it for 10 cents an hour.

Is that what you want? The USA adopting an economic system like China with no minimum wage, no workers rights, no unions, no social security, no paid maternity, no sick leave, and no universal healthcare?

Those who refuse to learn from history are doomed to repeat it.
