ISSUES:

"Manslaughter" - research and think through how much this applies. Prepare your defense case. Requires intention to harm.

"Involuntery manslaughter" - research like above. Less serious offense. Go for that. Argue there was no intention to harm the passenger.

Age 18 means your defendant will be tried as an adult. So all normal laws apply.

Texting while driving means you need to prepare for prosecution saying the defendant was guilty of "gross negligence" and/or "inattentive driving"

Passenger not wearing a seatbelt -> Your defendant is responsible for seeing that all passengers have their belts on. The prosecution will try to say it's the defendant's fault for driving until the passenger was wearing the belt. Prepare arguments against that.

Vehicle prone to roll -> Try to blame the manufacturer, and sue them. Not a defense though.

Driver was not speeding -> expected, just like not being drunk or under the influence of drugs. So the defendant did not make the accident worse on account of speed. The ejection wasn't made worse by speeding, it's the passenger's fault for not wearing a seatbelt.

A seatbelt would have held the passenger in place if he/she had worn it.
Attack the prosecution / victim. They had the responsibility for wearing a belt. If wearing a seat belt, the passenger would have been held in the car safely, would not have been ejected, would not have died. Injured, not dead.

What do the press usually call someone who has been convicted of manslaughter? A "manslaughterer"? Or is convicted felon the most common? Can someone be convicted more than once for manslaughter (in separate incidents)?

I heard this a long time ago in high school, not from very dependable sources (obviously), and I was just wondering if it held any truths at all. The way I heard it, no one has to actually die, its only if you have it on you at all.
