Is it legal to drive a gas go kart in a neighborhood?

Pretty much as it says, I have a 4 stroke 79cc gas go kart/dune buggy, I don't yet have a license, so a car is out of question for now. Will I get arrested, do I need a license? (In Texas, by the way.)

Well, me and my friend want to build 2 Go Karts. I live In a Cul de sac, near parks and side roads and a little pond thing by my house, we would never take it onto a Main Street or highway, we'd just boot around the park and drive around the side roads...is this illegal? We'd wear a helmet, and use safety harnesses, so just wondering before we pour all this money into building it, if we'd be able to ride it around our neighbourhood. Thanks for the help.

You *can* drive a go kart. You can drive it on a kart track. Karting is a blast on the track.
You can not drive it legally or safely on the streets.

A helmet is required on the track. A helmet on the street will not save your life on the streets.

Riding on the street you can be arrested and cited if seen by a cop. Your kart would likely be impounded and costs would be more than the kart was worth.

Your kart is very low, and will not be expected on the streets and will not be seen. A car would hit into you and probably over you and your kart. Being squished by a 4,000 pound car will not help a helmet very much.

Can you drive a go kart in your yard?

Yes. Its private property, and your parents land. Just dont do it past 10 at night, as it might irriatate the neighbors, and you could get a citation for "Disturbing the peace" But then again, who cares what others think?

I drive a golf cart in my neighborhood, is it illegal to do that?

That would depend on what the traffic laws are in your city or county.Driving a golf cart on the road is illegal unless the jurisdiction has made exceptions for certain areas. Being in Florida I have seen numerous towns where the city council has made it legal to drive golf carts on public roads with certain stipulations.You may have to have the same equipment as on a car such as headlights, tail and brake lights, turn signals and an orange flag on the rear signaling a slow moving vehicle. In addition you may have to register the cart and carry insurance on it. There is a city here in Florida called Sun City where the majority of the traffic is golf carts. It is very funny to see the seniors trying to outdo each other by tricking out their carts.To see if it is legal in your area simply call your local station house and ask.

Is it legal to drive a homemade go kart on the streets in Florida?

Well after sorting through the legal muck, the short answer is yes it is legal. The long answer is yes, but you need a few things. Here is the statute regarding low speed vehicles from the Florida DMV website (I also included the definition of a low speed vehicle):

"Section 316.2122, Florida Statutes, provides that the operation of a low-speed vehicle, as defined in s. 320.01(42), on any road as defined in s. 334.03(15) or (33), is authorized with the following restrictions:

(1) A low-speed vehicle may be operated only on streets where the posted speed limit is 35 miles per hour or less. This does not prohibit a low-speed vehicle from crossing a road or street at an intersection where the road or street has a posted speed limit of more than 35 miles per hour.

(2) A low-speed vehicle must be equipped with headlamps, stop lamps, turn signal lamps, taillamps, reflex reflectors, parking brakes, rearview mirrors, windshields, seat belts, and vehicle identification numbers.

(3) A low-speed vehicle must be registered and insured in accordance with s. 320.02.

(4) Any person operating a low-speed vehicle must have in his or her possession a valid driver's license.

(5) A county or municipality may prohibit the operation of low-speed vehicles on any road under its jurisdiction if the governing body of the county or municipality determines that such prohibition is necessary in the interest of safety.

(6) The Department of Transportation may prohibit the operation of low-speed vehicles on any road under its jurisdiction if it determines that such prohibition is necessary in the interest of safety.


Section 320.01 (42), Florida Statutes, defines "Low-speed vehicle" as any four-wheeled electric vehicle whose top speed is greater than 20 miles per hour but not greater than 25 miles per hour, including neighborhood electric vehicles. Low-speed vehicles must comply with the safety standards in 49 C.F.R. s. 571.500 and s. 316.2122. Any retailer who sells low-speed vehicles must have a dealer's license.

NOTE: The U. S. Department of Transportation National Safety Administration (NHTSA) added a new ruling on July 1, 2005, which states that all low-speed vehicles must weigh less than 2,500 pounds."

Is it legal to drive a go-kart in a parking lot?

If you have the permission of the owner of the parking lot and it is not accessible to the general public you will not be breaking any laws.However if there are complaints from neighbours about noise or the authorities consider there is a public nuisance or safety issues you could be prosecuted in a private prosecution.The chances are that you will first receive a private caution then, if you persist, receive a notice of intended prosecution.Be as discrete as possible and only drive your cart when there is no one else around and stop as soon as you receive any complaint. Fit the machine with an effective silencer. In that case I think the worst that will happen will be a friendly caution.Best regards Bob.
