My daughter's father wants her ss#?

My daughter's father wants her social security number, he says its to open a savings account for her.
I have talked to a couple of lawyers who say that I shouldn't give it to him. They say he can claim her on his taxes or open accounts in her name. I've also heard her father joke about doing these things in the past.
He insists that he will be able to get it, but he doesn't have her birth certificate.
He is listed as her father on the birth certificate and we were never married.
Can he get her social security number? Or will she be protected, we haven't done any filings with custody yet, but I want to make sure that my daughter is okay.
He lives in CA where she was born and I moved to CT a month ago
I can't apply for full custody till April according to the lawyer, and then I can change her name as well.

Who can help me change my daughter's name in NC?

My daughter's birth certificate has an error on it. It is my fault for putting off the correction. According the VA, where she was born, I first have to get a court order for name change where we live now, which is Randolph Co, NC. I've done a name change in VA and it was easy. I called the Clerk of Court here and was told they can't give legal advice, to call a lawyer. I did, he said it was easy, I didn't really need to pay him $300 when I could do it myself. I called the clerk's office back, but they won't tell me anything other than I have to post a notice for ten days. They won't even tell me what is required to be on that notice. They say that it is giving legal advice. I want to do this myself, I just need to find out what the steps and requirements are to change my daughter's name in Randolph Co, NC. The only thing I found online so far is the template for the Petition for Change of Name of a Minor. I need to know what else I have to do. Thank you for any and all assistance.

Who has the legal naming rights of a new baby?

I am an OB nurse & know the US law for birth certificates & naming. The mother is the only one who *legally* has a right to name the child per the birth certificate. That's not to say the dad or grandparent can't legally fill out the paperwork, just that it's ultimately up to the mother as to what the child is named.
The child doesn't *have* to have the mother or fathers last name, and it doesn't matter if they are married or not. Legally, in the US, you can give the child any name you want.
If mom is single, last name Jones and dad is single, last name Smith, mom can still legally give the baby the last name Davis, Johnson, Zappa, or she can give her child her name, dad's name, or a hyphenated name. It doesn't matter. The same is true if the parents are married. You can give your child any name you wish and the birth mother has the legal authority to make the final say as to the name of the child.

How do I get a birth certificate with my new legal name?

Hi there, I know this is an old question but for those people out there looking for answers as I was too, here it is. After changing my daughter's legal name which was an annoying process and very costly (although MA have waivers for those who qualify), after several process I got the approval by the court to change my daughter's name. After I went on in a search on how to make the change on the birth certificate, went to city hall of both town where I live and town where she was born, went back to the court, went to the "Massachusetts Vital Records Dept., and all of them gave me the same answer. The law varies in different states but in our lovely MA, IT IS NOT allow to change the name on the birth certificate, no matter what legal document states that you have a different name now. I was told by the MVR Dept. that until MA change the law, there’s nothing they can do to change a birth certificate name. Which if you ask me, it is absolutely ridiculous and absurd that after the court allows you to change it, the state does not allow it on the one document that it’s most required everywhere you go, so for the rest of our life we have to carry a copy of the legal court order with the birth certificate and explained the whole name issue where ever you go and is required. If anyone finds a way to do otherwise, please do share because I have exhausted all possibility to do it and still haven't find a way. :(

That depends on when the child was born and whether or not the parents are married at the time of the birth. US nationality laws have changed over the years and the changes generally were not retroactive, so I will speak about the laws that are currently in effect.If a child is born outside the US to a father who is a US citizen and a mother is not a US citizen, the child will be a US citizen:IF THE PARENTS ARE MARRIED TO EACH OTHER:The US citizen parent (in this case, the father) had spent at least five years of physical presence in the US, with at least two of those years being after the father reached the age of fourteen.The years of physical presence do not have to be continuous, they just must total at least five years, and two of those years must be after the father was fourteen years old.The father must be the child’s genetic father and must be the child’s legal father under the laws of the country where the birth took place.IF THE PARENTS ARE NOT MARRIED TO EACH OTHER:A blood relationship between the person and the father is established by clear and convincing evidence;The father had the nationality of the United States at the time of the person’s birth;The father was physically present in the United States or its outlying possessions prior to the child’s birth for five years, at least two of which were after reaching the age of 14.The father (unless deceased) has agreed in writing to provide financial support for the person until the person reaches the age of 18 years, andWhile the person is under the age of 18 years --the person is legitimated under the law of his/her residence or domicile,the father acknowledges paternity of the person in writing under oath, orthe paternity of the person is established by adjudication of a competent court.You can get more information from the US Department of State at:Acquisition of U.S. Citizenship by a Child Born Abroad

Legal issues for child custody between unmarried parents?

My nephew conceived a son during casual sex. The baby is now over a year old and all is not well in the parent's relationship. They are living together but as everyone knows, casual sex is a poor way to choose a life partner. The mother has threatened that if my nephew doesn't do what she wants him to on a daily basis, she will take the baby back to her home state (several hundred miles away) and her very dysfunctional family. What legal options does he have? He now lives near his extended family, all of whom are very supportive and involved with the baby. His name is on the birth certificate and he was present at the delivery. He ADORES his son and is distraught at the idea of losing him. Dad is amazingly tender and loving with his son and he is terrified that she will take off out of state with the baby. What legal options does he have? How likely would it be for him to get custody and how would he go about it?

Will the Hospital keep my baby's Birth Certificate until we pay?

First of all congratulations, you will have a wonderful new baby to welcome to the world soon.

You will actually get the baby's birth certificate from the state in which you reside.

The hospital cannot hold it until the bill is paid.

I am sorry to hear that you were spoken to in such a mean and rude manner. If you can get the persons name who treated you poorly, she should be reported to her supervisor.
If you know when you called and what number or extension you used, it should be easy to find out who the person was.

No one should be discriminated against in a hospital setting based on the fact that they are not insured, millions of people are not insured, do not be embarrassed.

Don't get upset over things like this, no matter what is going on in your life, you stress can affect the baby so think calm thoughts and be happy.

The hospital will bill you, and I know that they will work out a payment plan for you, so that you do not have to pay it all at once.
