This is needed to find out what, in their mind, is causing a problem and address that - otherwise you can be spending your time and breath on something that has no relevance to that person.Also, a welcoming approach to the situation will let the person know that you are open to a dialogue and that you're genuine about hearing their grievances and would like to reconcile.If a person is hostile, as much as it pains you, I would advise leaving the whole situation as-is: no matter what hoops you'll jump through, there will never be enough for that person; in the process, you will be basically under that person's control, however the end goal would be to torment you and not to reach a compromise or an understanding.It's just not worth it.

People in some cultures stand very close to each other to speak to anyone, consider it rude to stand away, and other cultures stand a few feet away unless it's a romantic involvement.
So, one guy steps forward, the other steps back, and it continues on around the room.
In some cultures, if you accept a gift, you should immediately give something in return or it's an insult.
Then there's the good old American, "Oh, don't go yet!" polite hospitality...where the guests end up staying till after midnight when they wanted to go home at eight, believing they shouldn't leave until their host said they could.
Or phone calls, where one person believes only the caller has the right to end the call....and they believe the person who's called has that responsibility. And they stay on the phone for hours, both angry at the other one.

Why do people misunderstand each other?

Because no one takes the time to really listen, or to ask questions if they take something offensively. Instead they jump to their own conclusion and react. A misunderstanding can happen in alot of ways. But mostly by someones body language and tone of voice. Alot of my friends have thought I was sad when I was actually angry, and angry when I was actually sad. They asked me so we were able to talk it out. But how many times does a person misunderstand someones body language or tone of voice and not talk about it. Thats why people misunderstand.

Yeah, I can give you a partial answer on this one:

Boiled down, its most likely to be because the american jurers misunderstand or dont understand Japanese customs and mannerisms.

Ive been in Hawaii for 25 years, have had 5 jap girlfriends, hawaii is full of Japanese and Ive been to Japan several times. So I can understand how this could be the case.

its kinda difficult to convey - you have to see it in action to really get it. But it goes kinda like this: they are polite. There are certain things that they do and dont do that are just different over there. Knowing how they act, I can envision a Japanese national on the stand and see that they would do these things:
1) fail to make eye contact (its considered rude in Japan and would be even moreso rude when dealing with someone having altitude, like a judge - or jury for that matter)
2) they arent the kind of people that jump up and yell "Yeah, it was that rotten guy right there! - Know what he did?!? Let me tell you..." Theyre like overly polite and will tend to downplay things - hope you get that one.

3) Their attitude is "meaker" - its definately not "assertive". This could be mistaken by americans for dishonestly or witholding info or secretiveness.

This would be mostly true of Japanese from Japan (not raised in America).

4) One more thing is that Japanese have this odd custom/habit/cultural thing of "not saying what they really mean". hard to describe.... heres an example: You dont just blundtly blurt out the harsh truth of something - you allude to it. thats their style. Like if you tell a chic you like "Hey, youre hot. I like you" - its a little too direct for them. Its WAY worse if you say something good about yourself: Try goin to Japan and saying "Yeah, Im the MAN!" in even a half-serious manner - you'll loose some serious points. Their way is to claim that they arent good (its a humble thing) and is related to the polite and non-assertive nature of their culture.

Most common misunderstanding:Some think that Azerbaijani is nation name. Indeed , it is a name for citizenship of Azerbaijan Republic. Azerbaijanis are sum of Turks (90%) and other ethnic groups.And some think that Azeris is name for Azerbaijan people. It is WRONG. Iranian government came out with the idea that as if 35 mln Turks in iran is not Turk. They are Azeris and Farsi nation. Because of Turkish population of Azerbaijan and Iran are same , this word started to be used for Azerbaijan also. Stupid medias in Turkey accelerate uses of Azeri for Turks (Azerbaijan and Iran). And people get effected by medias.People in Azerbaijan who state themselves as "azeri" are potentially uneducated or non-Turk ones who hate Turks.

I did some student teaching in an 8th grade English classroom where there were eleven different languages represented among the students. The most difficult concepts for the students to grasp involved words that had two completely dissimilar meanings. For example, one student was stumped when she read a sentence that referred to a four-story building. To her, a story was in a book. She also had never heard the term animal sanctuary - she thought it meant a church for animals, which was an odd notion to her. Another student didn't understand the sentence "When I saw the bear, I was quiet and still." The "still" didn't make sense - he kept asking "He was still what? Still scared?"
Not as humorous as your Indian story, but it made me realize why other languages are sometimes difficult for people to learn.
