Yes, of course one person can sue another because that person owes him money. In fact, that's what most lawsuits are about in one way or another.

And while none of us knows the details of your situation, I assume this guy wants to sue you because you owe him money. Simple as that and it probably doesn't matter to him whether or not it was your fault or whether you have other stuff to pay off. This guy would rather get paid first, just like the guys or stores or whatever you intend to pay off first want to get paid.

And, if he does sue you and he wins, he can collect by using methods available under the state's law, which might include retraining your bank account or garnishing your wages.

It's a sleazy behavior that works. Fake sincerity and phony gratitude for "helping" them can get them more money. If you have copies of your texts, take them to court. I'd send one more text with something like, "On such-and-such a day, I loaned you $XXX. You agreed to pay the money back within ___ days. I've tried to get my money from you ___ times already and you won't return my calls or reply to my texts. As agreed, the money was just for a short time, and you won't pay me back." This will put the burden of arguing on the other person. Keep all your texts and emails for when you go to court. ... Best of luck!

It s been a year since I ve lent someone money. He/she promised to pay it back, but now, he s/she s saying that he/she has no memories of borrowing money from me and pretending now to know anything. Of course, you can sue anyone for anything. My advice is to think of this as a learning experience. You loaned someone $300. Move on. I took a former roommate to small claims court when I was in college and won. The downside? Winning in court doesn't mean collecting money. To collect money I would have to hire a lawyer to enforce the judgement. The only asset my former roommate had was a used Honda Accord and I could have had a lien placed against the car and when/if he sold it I might be able to get my money. It was just so much work. I had fun winning in small claims court, but eventually I got out of school and got a job and decided to forgive the debt and move on with my life. I bet you could earn $300 far easier than actually doing everything necessary to get your $300 back.

Well in California for about $20 they can file their case in small claims court. Then have you served a summons and you appear before a judge where you both tell your side of the story. In small claims court heresay evidence is admissable so it is a little easier to present a case.

If the judge agrees with the plaintiff (the guy suing), then a judgement is entered into the court system. Once that judgement is in, you OFFICIALLY owe money and the person has the ability to take further action to collect the debt or simply turn it over to a collection agency to hound you daily and ruin your credit.

If you have a bank account, own property of value, or have a job, the guy can wait for for up to 14 years to come after you - all the time collecting better interest then you could ever get at a bank. (7% or so) that you will owe.

If you do not plan to hold a job for 14 years you can prob. beat it.. but don't count on it.

Can someone report you to the police if you owe them money?

My old employers offered to lend me $1000 about 10 months ago so I could go to school. I have every intention to pay them back, it's just at this time with being in school full time and without any support from anyone I'm finding it really difficult to do so. They have sent me many threats of reporting it to the police, I just want to know if this is possible or are they just saying anything to scare me (which is what i totally think they are trying to do..) If it helps, there was no written agreement or anything like that.

so i owe this guy abuot 1200 bux... i told him that i would pay him a bit later cause i raelly odnt have the money now i lost my job ... but he has gotten so mad he has threaten me.. n said hes going to work with human resources and the manager at the place i work to get the cops after me and court n stuff... im scared but at the same time i cant do anything cause i just simply dont have the money yet n i said im sorry i told him that i already trying my best to pay him im not tryin to run away or anything.. but he still persist on getting the cops on me.. can he do what he says hes going to do?
