Can They Arrest People That Deal Legal Drug Substances

If someone were to plant drugs in ones car and get them arrested, how can they prove it isn't theirs in court?

Someone planted crack/pipe in my friends' car one night, who has never done crack or cocaine..he then followed said friend to work and called the police, anonymously, and had her arrested at her job. The cop said they would not fingerprint the substance, nor give her a drug test. She was charged with possession of controlled substance and possession of drug paraphernalia. She is going to see a lawyer soon but I thought maybe someone would have some advice. She also was never mirandarized.

What exactly does an arrest for possession of a controlled substance mean?

A controlled substance can be anything listed on one of the schedules of the controlled substance act. The schedules can be found here:

Typically if you are caught with anything on schedule I, II or III you can be charged with possession of a controlled substance. This can include perscription medications if your state law lists its non-perscribed possession as a crime (most likely a schedule III drug like hydrocodone). If a person has lortabs or a similar perscription drug outside of a bottle with no script for it they will be charged and have to show that they were allowed to possess it when they go to court.

Even then though, many states have a charge for carrying a controlled perscription outside of its container. Typically just a fine though.

Can police arrest you for saying you are using illegal drugs?

The real question is why would you be talking to the police? Remember, the police are not your friends. They are trained to look for criminal activity and will cradle you to make you lower your defenses. Sure, there is that occasional video showing one giving a teddy bear to a child, break dancing, playing hoops or rapping with the neighborhood gang of kids. Big deal. Drug dealers do that too. They’re just not thirsty for the PR.There is a YouTube video of a grandmother who let the police in her house as they were going door to door giving security advice. Grandma let them in and one of them happened to look under the sofa cushion and found a baggie of pot. It belonged to the grandmother's granddaughter who stayed there the week before. Grandma took the rap and got ten years probation. As they did a thorough sweep of her house, one of them found and kept five thousand dollars cash. Who are you going to beleive? An honest cop or a drug dealer granny?Anything you say can and will be used against you.

How is it legal for police to sell someone drugs and then arrest that person for purchasing drugs? Aren't both actions, trafficking and purchasing, illegal? Also, is it not entrapment?

Everything is legal as far as the police are concerned. They break the law everyday and some I'd say break it every encounter.They CAN pinch someone for buying drugs but they usually aim higher and try to climb the ladder by catching dealers. The will sometimes go for users when they feel like a drug and the crimes connected to it are becoming an epidemic.All this is perfectly legal unless it's entrapment. It's only entrapment if the person is persuaded into committing a crime that they would normally be unwilling or unlikely to commit.For example a person who has no involvement with drugs goes out and scores some dope because he is talked into it by an attractive woman who's an undercover cop.Normally this person would never do such a thing but he's persuaded by the attractive undercover to gain her interest.Entrapment happens all the time and people get charged and convicted of crimes they normally would not be taking part of.

Why do people get arrested for smoking marijuana?

Because there are many studies that supposedly shows marijuana being able to help with a few certain illnesses, where a lot of the pharmaceutical companies normally would make big bucks trying to force people to use less effective drugs to cure it.

Therefor, if marijuana were legalized, a lot of the pharmaceuticals would lose a lot of money in the process.

Besides the medical parts, there's also the hemp part.


But bottom line, in the end, if marijuana was legalized, many of the companies would suffer.


By the way, don't get me wrong, I think it's quite stupid that they purposely legalize alcohol and cigarettes but not weed. I mean really, what about drunk driving? second hand smoke? Heavily processed junk foods?

How does a drug dealer get caught?

Well, there are many ways you can get caught but its only a VERY stupid man that things the law is stupid. They spend there time bringing down million pound drug empires so why cant they bring down a kid that hasn't even graduated school yet? You are NOT smarter then drug enforcement officers that have been doing this before you were even born. If you do want to get away with it you don't deal to people you don't know, you aren't in it for the glory and to be a face (these either end up caught or dead) and you only deal to your very close Friends. Don't carry lots of weed on your person or bags. You need to pre-organise the deal and only take the amount you are selling. Although these only keep you going for a little while. Everyone gets greedy and there's three ways a drug dealer stops. Either death,prison or they quit and I would say only around 10% quit.

Can you get arrested for selling fake drugs?

This is slightly tangential . . .I taught at a private high school in the US some years ago. Two of our students were reported to be using drugs. After a search of their room a bag was found containing two ecstasy tablets. Both were put before the disciplinary committee. One of the students denied using the drugs, the other confessed. Nonetheless both were required to withdraw, i.e. expelled, because the totality of the evidence available clearly implicated both of them in the drug use.Subsequently, the tablets were sent off to a lab to be tested. It turned out they were something harmless like aspirin: the two kids had been sold fake ecstasy. The one who had denied taking drugs was reinstated but the one who had confessed was not. The argument was that the one who had denied taking drugs was effectively telling the truth, albeit inadvertently, because he had not in fact been taking drugs.At the subsequent faculty meeting, I said this was wholly unfair. The message it sent to the student body was that lying is the best way to go. The principal said that he disagreed and that people who do bad things get caught out eventually.

Can i get arrested for pretending i have drugs?

i was watching border wars and was wondering if someone could get in trouble if they wrapped oregano or flour like drugs and tried to "sneak" them in and the cops found it and found out it was flour or oregano would you get in trouble legally for messing with them or lets say you have it out in the open so they notice it and they grab it and question you
