Can unemployment deny your benefits for failing a drug test?

Well, the two main reasons people get denied are being at fault for the loss of the job, IE if you, hypothetically, got fired for attendance or something else like that. The other reason is that your state determines that you are not "able and available" for work. Usually failing a drug test is grounds for termination, so you would most likely be considered not able and available, as passing a drug test would be required to regain employment. So unfortunately, I don't think you would be able to appeal.

Would taking pain meds allow you to work? If a strong case can be made for that, then refusing could complicate things for you. From what you've described, I don't think that's at all likely.

Disability decisions (in the U.S.) hinge on two things: 1) having a diagnosis, doesn't matter how accurate, they just need a name to hang it on; and 2) ability to work. You have the first, so your concern now is on demonstrating, via the forms etc, your problems with the second.

Every time you fill out the forms (refusals and appeals are unfortunately part of the process), write from the point of view of your WORST day. Forget all of the coping strategies you use. And then do something really nice for yourself, because it's bloody demoralizing to look directly into the eyes of what we go through.

SS physicians aren't the nicest bunch. But don't worry about that, it's par for the course. As long as you have the rheumy on your side, you'll be fine. (SS docs won't care enough to take the time to discuss much in the way of treatment options. S/he'll just look for signs and ask lots of questions. And remember -- confusion is an excellent reason why you can't work. If you get confused in the doctor's office, use it. :-)

O.K Yes I have applied and went through all their processes. I was also denied and I am in the process of appealing right now. I am trying to find an attorney right now. I have already figured out that the only way to deal with them is with a lawyer. Check this out, in the denial letter they agreed with me. They said that I had all the problems I said I did but that if I continued with the treatment and medications that I have been doing then I should be able to get some kind of menial job. Even though I specifically told them and showed them that the only reason I have been able to keep up with the treatments and meds so far is because I pulled ALL of my savings to do so and I am now out of money. They completly ignored the fact that I had one doctor that specifically stated that I was unable to work and needed to apply for disability.
Beyond that, if I did find a job that was double minimum wage, that would barely cover medical expenses leaving nothing for silly things like rent, food, utilites, miscellanius. I calculated that i would have to make a minimum starting salary of 16.25 an hour to get by.
I used to make really good money my disability payments would be pretty high. Let me also say they also agreed that I can't go back into my old carier.
So bottom line is. They say that I have the ability to find some kind of a job that wouldn't even pay expenses ( IF ) I keep up medical treatment that I can't pay for and they are not going to help me pay for. That I should be willing to accept a job (if I can find one) that will pay less than the benifits I would get from social security. They also decided to forget that the VA says I am 20 percent disabeled for service injuries. And no I'm not disabled enough to use the VA unless it's an emergency. My VA money is going towards life insurence so at lest when I die my kids won't have to roll me out to the curb on garbage day.
It's kind of like telling someone that is blind and only has one arm that they can't get any disability because they still have one arm left and they could do "something".
In the over 40 years that I have been paying social security taxes I have put in tens of thousands of dollars in and they say that even though they agree with me that I can't have any of my own money back.
