The, as you say, ask questions, be open, and ask if for awhile things can be different. Then, after your discussion see if things improve. If not, ask for a meeting with a supervisor above the person in question.

If you are working with a supervisor and they are acting against the law and harassing you have two choices: go to HR and report it with evidence, or find another job. If your supervisor is giving you poor reviews you can change your productivity you if you can't please them, find another job.

How can we manage conflict in the workplace?

According to the CPP Global Human Capital Report, 85% of employees around the world encounter conflict to some degree, and almost one third deal with it “always” or “frequently.”Those conflicts have all sorts of causes, according to Psychometrics: warring egos and personality clashes (86%), poor leadership (73%), lack of honesty (67%), stress (64%), and clashing values (59%).18% of those surveyed, meanwhile, indicated that their management and leadership are not at all effective at dealing with conflict, while 63% said that they are only somewhat effective. The costs of not engaging in conflict are high too: 25% of employees say that avoiding conflict resulted in sickness or absence from work, to say nothing of the immeasurable impact of conflict avoidance — and poor communication generally — on company performance. So generally speaking, we’re not too great at conflict.Because let’s be honest: conflict is really difficult. It’s inherently fraught, messy, and scary. It’s highly emotional. It often involves issues that are deeply personal and meaningful. And it depends on parts of our brain that are wired for some of the uglier parts of the human ego — the need to be right, the need to self-protect, and the desire to be victorious.Which makes it pretty damn hard to disagree gracefully. How do I resolve conflict in the workplace?

The question is vague and very broad. What kind of conflict are you talking about? The question has to be then tackled from two angles.Type of conflictYour role in organizationTYPE OF CONFLICT:There are different types of conflicts ranging from ‘who gets to use the copier’ to ‘is it considered racism’ and everything in between. Some conflicts are by nature easy to address, for example, setting timeslots for various groups for using copier. Then there are certain issues that you should NOT even try to broach without an HR present.YOUR ROLE IN ORGANIZATIONIf you are a Manager you can handle certain situations and if you are a staff you may not have the experience or ability to handle even minor conflicts. So depending on the intensity of the problem and your role - you can help find a resolution or find a person that is qualified to do so.Certain issues involving race, sex, discrimination, ethics, integrity etc should NOT be handled by anyone other than HR (even though you may be first line of defense in gathering information). These issues can blow out of proportion pretty quickly and including HR from the get go is the best thing.SOME COMMON THINGS YOU CAN DO FOR RESOLVING MOST CONFLICTSGather facts not opinions and feelings (although they are important)Guage the intensity of conflict and assess whether you are in the right role to address the conflict at handBring the parties involved into meeting and discuss the issue in open (where doing so will not aggravate the situation)Inform and involve right level of people in coming to an amicable solutionKnow that sometimes only way to resolve a conflict is to make hard choices (could be because of nature of individuals involved or nature of conflict itself)Be as impartial as possible and focus on issue at hand rather than individualsIf you suspect that you may be biased because of people involved (this is a common case) - find someone that will act without bias to help resolve the conflict. If you proceed knowing you could act biased then this may pose another set of conflict in future and you will have lost the opportunity to demonstrate fairness at your workplace.Ask any more questions directly here: Jobinterviewboard
