First Time Offense Traffic Violation - Help

Nervous about traffic violation court-please help.?

hi, i live in ohio and im 16 years old and i was pulled over and given a traffic violation for not yielding to oncoming traffic.
im extremely nervous because i think you can get your license taken away...and i rely on it to get to and from school.
im going to try to plead not guilty....please help

First time going to court for a minor traffic violation, what to expect?

Your state, your age and what kind of traffic violation you received determines if you have to appear in court. It is normal to be nervous. You will check in (either with the clerk or with the solicitor), hear the Judge's instruction, wait for your name to be called, plea guilty, not guilty, or Nolo. If you plea guilty, the solicitor will state the facts and the Judge will then ask you questions. Explain to the Judge what happen. Then the Judge will give his/her ruling and ask if you can pay for the citation now. Usually the fine is a set amount.You pay and leave.
If you plea not guilty, another court date will be set. If you can not pay the citation (usually within 30 days) the Judge can put you on probation. Every state/court is different on how they handle traffic violations, but this is what I've seen.
And for Nolo, depending on your age and the violation that plea might not be acceptable.

That does sound high for his first time offense. The statewide schedule calls for a fine of $76 for a first violation of CVC § 23123(a). That is a base fine of $20 plus penalty assessments. Each county may be slightly different, but not by that much! Naturally I would tell him to contest it entirely, but we must also consider both of the following: (1) this would cause him to miss work, and (2) no points will go on his license if guilty (CVC § 12810.3). So, have him fight it using a trial by written declaration (trial by mail) and if he does not win then write a letter to the judge asking to reduce that fine by half.

Traffic ticket: incorrect violation code?

So I got my first traffic ticket, and intended to plea bargain in order to prevent any points from accumulating on my license. After reviewing the ticket, it seems the officer might have made an error, giving me a slightly more expensive offense.

In Newark I turned onto a st from one that prevented any turns (no turn sign, didn't see it). In NJ, that is statute 23:3-1

However, I was charged with "failure to turn", 39:4-124
Obviously, I did not fail to turn, instead made an illegal turned.

If I try to fight this, would I win?

Also, should I just mention that the ticket is an error, and if so, let it get dismissed, or if not, then try to plea bargain? I wouldn't like to miss the opportunity to plea bargain.

First time offense in WI (retail theft)?

This is a question for your lawyer. If they feel the search was unlawful, then any evidence they found when searching you is inadmissible, which could mean you'd get off. Unless there is security footage (that could have been a lie to get you to allow the search, cops are allowed to lie), if there's clear footage that in itself is pretty damning evidence.

The search sound lawful since you did eventually agree to it, and you were not coerced by unlawful means. It sounds like you'll be pleading guilty on this one.

That said your circumstances put you in a position for some leniency. The fact that it was your first offense, that you're a good student, upstanding citizen, volunteer, the fact that you just had a baby (we can argue this is a life change and under your new circumstances you would no longer commit the crime). If you are convicted you will have a record but you can go about getting it expunged. Here's a quick google result for expunging a record in WI:

But again, that's a question for your lawyer. You do usually have to pay some money to get the record expunged. The NY letter does sound scammy to me, since you haven't actually been convicted yet.

If you plan on pleading not guilty, then get a good (more expensive) lawyer. If you plan on pleading guilty (which based on this info it sound like you should), then it's sometimes best to go with a (cheap or usually free) Public Defender who will be on more friendly terms the judge and prosecutor and be able to genuinely plea for leniency.

The fine for a first time offense is not less than $100 and not more than $1,000. The minimum fine escalates to $500 on a second offense and $750 on a third offense, but $1,000 remains the maximum fine.

The officer was kind of a putz. The fine for 1-15 mph over the limit is about $234. The fine for 16-25 over is $360. If it is worth your time to go to court, I think most judges would agree that the officer could have made a 1 mph mistake in your speed and impose the lower fine.

BTW, the judge will NOT want to hear that you were going with the flow of traffic. It is illegal to exceed the maximum speed limit (65 where you were) no matter what the rest of traffic is doing. Just tell the judge you do not believe you were going over 80 mph.

Either way, you will want to sign up for traffic school. That will add about $50 to the cost, but avoid the DMV point and any insurance consequences. If you choose not to go to court, you should be able to take care of everything, including traffic school, online.

The scheduled fine is $146. Traffic school will cost a bit more but keep it off your record.

BTW, this is not a priorable offense--the fine is the same no matter what your record.
