What's a typically unknown US law that the average citizen should know?

In the United States a person can be held liable if they try to help someone (for example a victim of a recent car wreck or a person struggling in the water), and in the process hurt them further (especially if the person dies).  Although some states have laws (Good Samaritan Laws) that protect the person helping, many Good Samaritan Laws only protect professionals (e.g., doctors), so as to encourage informal (e.g., medical) help by these professionals, but not from a layperson.  Most states do not have a Good Samaritan Law.  Obviously, a person may also feel a compelling moral duty to help regardless of this potential liability, but this common law (this means law made by courts, not legislators) liability is certainly worth knowing, so that you can take into consideration (1) how effective and successful your efforts to be helpful are likely to be, (2) the likelihood that other more competent help may arrive soon, and (3) how likely it is that the person "needing" your help may actually be OK without your assistance.  These are good things to think about anyhow, but they are also things that any judge in a trial court would consider (if you were actually sued) in later judging your actions and determining your liability.  Of course, after considering 1, 2, and 3, you may decide that you should still drag that person out from under a car with gasoline leaking out of it, but you may also decide that the most useful thing that you can do is to call 9-1-1.The reason that this liability exists is that although well-intentioned, you may actively worsen a situation if you don't think through your actions carefully in advance, causing paralysis in an accident victim that you move, or drowning a person struggling in the water when in trying to "help" you drop in a plank for her to grab and knock her out, or etc.  If, however, after considering items 1, 2, and 3, you feel very clear that you can help, and/or that only by helping can you save the person's life (or limb, or etc.), it is likely that a court will agree.  So don't let a person struggling in the water drown or a wreck victim burn unnecessarily, just be aware that you still have a very real legal responsibility to act thoughtfully and cautiously even as you are trying to help.

How does the Walmart attendance policy work?

You really shouldn’t play the game with attendance at any company. Unlike some companies, Walmart is very serious about it. Most Walmart stores are short-handed and call-ins just make it worse. With 3 absences in 6 months, you’re on the verge of being fired and you don’t even have to miss a full day. What happens if power goes out and your alarm doesn’t go off so you oversleep? What if there’s an accident on the way to work and you get stuck in traffic because of it?Somebody in another answer said if you switch jobs, word gets around about what type of employee you are. A former coworker of mine played the attendance game at Walmart and eventually lost so he was fired. About 2 months later, he had a job interview with another company and when he showed up, he discovered that the interview was with one of his former managers from Walmart. Now, this manager actually decided to give him a chance and as far as I know, he’s still at that company and doing well, but it could have very easily gone badly for him just because he wanted to say he had a job, but didn’t want to go to work.

Avoiding Work: What is the easiest illness to fake in front of a doctor so you can get him to write you a note so that you won't have to go to work for the next couple of days?

I’ve had several staff & co-workers fake illnesses before. Back Pain, migraine and PMS are the easiest to fake, but if you are planning to be a liar, just remember that the consequences of your deceit can follow you for years after you’ve enjoyed your ill-gotten days off.Back Pain: Two of my staff were so blatant about it that they even went to see the doctor together and took sick days together. They were in their late forties and always complained of chronic back pain. We knew it was fake. These two ladies worked on shift and at first, they always had back pain when they were rostered to do front desk duties. Then we instituted a policy that if someone covered a colleague’s front desk duty, they had to be “paid back”. The two fakers promptly only fell ill when they were not on front desk duty. They were culled in a retrenchment exercise.Feeling Under The Weather: One of my bosses was sympathetic to those who worked in high-stress teams. So when a staff wasn’t feeling good and wanted to stay home to rest, she didn’t mind. A few hours later, the boss comes to the office in a fury. She had gone to the shops during her lunch hour and ran into Mr Not-Feeling-Well who was happily shopping with his family. The Useful Parents: An ex-coworker had run out of excuses of his own - fever, mysterious aches and pains, hangover, lost wallet, lost passport, lost memory (he forgot when his vacation ended). So he started using his parents: elderly father not feeling well, mentally ill mother throwing a tantrum. We knew it was all faked because all the days that he missed work were the days when his project deadlines were due.

How many days can you miss working at walmart?

Walmart has two different attendance policies depending on how long you've been with the company. Here's how they work:If you clock in ten or more minutes late or clock out ten or more minutes early, you get one half of an attendance occurrenceIf you miss more than two hours of your shift, you get one attendance occurrence. If you call in, you get one attendance occurrence. If you no-call-no-show, you get four attendance occurrences.Attendance occurrences fall off after six months. If you are a new hire who has not completed your pathways training, you are only allowed 3.5 occurrences in a six month period. When you reach 4 occurrences, you will be automatically terminated from the company. If you have completed your pathways and have passed your sixth month with the company, you are only allowed 8.5 occurrences in a six month period. If you reach 9 occurrences, you will be automatically terminated from the company.Remember, Walmart doesn't coach or write up employees based on attendance. It is your responsibility to keep up with how many occurrences you have. You may keep track of them through the GTA portal on the Wire. If you believe you have received an occurrence incorrectly, you may discuss them with a salary member of management within 30 days.

Should I give my baby up for adoption?

I have just entered my ninth month of pregnancy and I am starting to become so afraid. I broke up with the baby's father about halfway through the pregnancy because he refused to look for work (and I was about to go on maternity leave). He had been leaving the house every day for hours and pretending he was looking for work, and I found out he was just going to his brother's and checking his Facebook and getting drunk.
I have already dealt with the emotional damage he has caused me and I know I have to be strong for my baby. But after the break-up, I have since had to go on welfare to support myself because I can't work - I have a high-risk pregnancy and HAD to take maternity leave beginning early. I was called in to finish some paperwork, which ended up being my pink slip, so I no longer have a job to go back to. I am starting to become extremely worried about how I am going to manage finding a new job, working, taking care of the baby, keeping my home in order, and my own sanity and well-being, all on my own. I planned to have a partner to help me balance all of this, but he doesn't seem to want anything to do with the family now. I just don't know what to do, and I feel like my baby's life will suffer because of my lack of money, and potentially my lack of a decent mental state.

I love my baby boy so much and there is nothing more I want to do than be a good mother to him, to raise him and nurture him and watch him grow up. I just don't know if I can do it... I am so afraid, and I don't know if this is the normal fear that new mothers feel before they grow into it, or if this is a bona fide good reason to be afraid. I am always striving to know everything about a difficult task before I tackle it, but this just doesn't seem to have any solutions. Should I wait it out, or do you think I should consider adoption very seriously?

How long do HR investigations usually take?

As people have already answered, it depends on many factors. It could go from days to weeks to months…As HR Professional, one tries to conduct all investigations as soon as possible (1–2 weeks), but sometimes it does not depend entirely on HR only. For example, if an investigation requires examining an employee’s computer, HR may not have expertise in computer forensics and must engage with a third party.I think it is worth mentioning that one thing is the actual investigation and another thing is the decision taken based on the outcome of the investigation.HR carries the investigation and writes a report with the facts and a recommendation of actions to take. But the actual decision typically depends on someone else in the top management of the company.Even if the investigation takes only 1 or 2 weeks, the decision might take much longer.
