JC Penny Background Check?

I went on a interview yesterday at JC Pennys and I did a excellent job and was the only one hired out the group on the spot and with a higher pay because of my experience and current education. Now here's the bad news. Three years ago I was out shopping with a friend and she got caught stealing a bracelet and she tried to hurry up and pull off but was stopped by the police. We were both charge with theft and con theft. I went to court and I told the judge I didn't steal anything and shouldn't be held accountable for someone else crime. He dismissed my theft charge but gave me a pbj for conspiracy to commit theft because I was fled with my former friend from the scene. I explained to him the reason was because I was in a unknown area and wouldn't have no other way of getting home so I panicked. Anyway he still gave me a pbj which I cant have removed until the 16th of sept. Will this show on my background and cause me to lose the job? I was doing a internship at American Red Cross and they did a background check and I came up clean. I'm really nervous :-(

Why is it that the only way to stop a bad guy with a gun is a good guy with a gun, instead of banning bad guys with guns?

Bad guys with guns are already banned. Why do FFLs run background checks when selling to the public? They are checking to see if the person they are selling to are the bad guys that should not have guns, like convicted felons, those declared by a court as mentally defective, illicit drug users, or anyone else in the data base listed as a person prohibited from owning a gun. It is why the gun-control crowd keeps pushing for universal background checks, because in their perfect world, it will stop all bad guys from getting guns.The problem is, bad guys still get guns. Bad guys are criminals. They are criminals because they do what they want to do in spite of the laws. Murder is illegal but they still murder. Robbery is illegal but they still rob. Why will adding 10 more laws stop them? Laws just keep the honest people honest. Go talk to the people in prison, they never thought they would be caught and they are all innocent anyway.Criminals and bad guys get guns any way they can; the black market, buy from people who will sell to anybody, steal them, build their own, buy from people who build them illegally, and any other way they can.Ban all guns and the bad guys will still get guns. In Mexico, guns are practically banned and yet they can be seen everywhere. Fully automatic weapons can be purchased cheaper there than here in the US. Corrupt government officials are selling them and probably from stock they purchased from the US.Years ago, when I was much younger, I was fine using the martial arts I learned for self-defense. I disarmed a few people who used guns to try to rob me. They made the mistake of getting close enough to me where I could reach out and disarm them.That changed 10 years ago when I had a stroke. I lost a lot of physical strength. I prefer a gun. I can still use my martial arts skill in limited situations. With a gun and martial arts skills I can use my gun more effectively even in close combat situations.

Actual guilt or innocence takes place outside of independent observation. Even if we aren't accused if we have commited a crime or just a faux pas then we are guilty. Guilt does not occur when someone else becomes aware of our bad behavior but when we commit it. That is why the phrase is ASSUMED innocent.The level of proof necessary to make a decision varies in different situations. If I am on a first date and feel like someone is being particularly dishonest I don't owe them a second date because I haven't proven my assertion beyond a shadow of a doubt. If I am conducting a job interview and the teen interviewee says he doesn't drink but smells like alcohol I don't have to administer a urine test to reject him as an employee. If he is already employed and acts drunk and smells drunk and I decide to fire him I need to provide evidence because firing as opposed to not hiring is punitive. If the result of my judgement involves incarceration or other loss of liberty then proof beyond a shadow of a doubt is needed.This is how we do this everyday with each other. If John is frequently dishonest then I can decide that I don't want to deal with him regardless of his guilt in this particular instance. If my potential employee is known to be a nuisance customer I am quite in the right to assume he is going to be a nuisance employee and because I don't owe him a job it is my right to assume he is guilty of being a less than optimum candidate. If he is overly excited or disrespectful during the interview I need not supply evidence of guilt just choose to disqualify him as a candidate. We all assume both guilt and innocence of each other every day the higher the consequences the more proof we expect to support that decision.

How bad does a minor misdemeanor look on a job application?

First, it does look bad. Employers would much prefer no record. However, it's a very understandable charge that can be explained as an isolated irresponsible incident. I would definitely say something about it in the interview. The fact is, because it's minor, it won't disqualify you for very many jobs, but it's still there. Even if they don't bring it up, they still know that it's there. Take full responsibility for your actions, and let them know that you don't participate in that type of behavior anymore. Just don't ignore the elephant in the room. They might be impressed by your candor, but either way it should set them at ease.
By the way, how long ago did this happen? Many background checks only go back 7 years. Also, usually first time misdemeanor offenses are eligible for expungement or sealing after you have completed your probation. If that's the case, I would HIGHLY recommend you get it taken care of, because then you wouldn't even have to put it down on an application. Why does my court date keep getting pushed back?

On January 24th I was charged with child abuse, which I would like to say that I'm totally innocent i would never hurt my daughters. It is now November and all my court dates keep getting pushed back. I haven't even been indicted on the charges yet. My lawyer tells me that the charges will probably be dropped. Until they do I can not get a decent job, I have had to leave the job I had before all this happened. Its getting really frustrating, can anybody give me a little more insight on the court systems please.

Are overzealous prosecution attorneys responsible for innocent spending life in prison?

I would say that on a rare occasion, an innocent victim is convicted of a crime without the evidence required for such a situation but these are not commonplace.

We do need to get facts and information to convict people who deserve to go to prison and we also need to stop pandering to criminals, giving them countless excuses and chances to overturn convictions that are completely legal and worthy of the crime committed.

It is really time to start looking at victims and their rights rather than the rights of criminals. It is time to put an end to the insane practice of "political correctness where the world turns itself inside out to make sure that no one has their feelings hurt and no one gets offended.

I, personally, am sick to death of hearing about how some murderer came from a bad background where they were deprived from having what others had so they turned to crime to comfort them. I don't care about any of that. I care about the victims of the crime, the families who suffer the loss of family members and who will suffer for the rest of their lives because of a crime committed by someone who felt they had the right to whatever criminal activity they chose to institute.

I give praise to those who work hard to prosecute and protect the victims and future victims of crime.

Yes, there are situations where things happen and mistakes are made but, for the most part, this is not a very common happening.

Prosecutors have a very difficult job and their aim is to protect the innocent and punish the guilty. There are appeals that are put through for that reason but I also feel as if the appeal process should be limited and that there shouldn't be decades of appeals going on.

(Most criminals in the US end up having a pretty darn good life; prisons with privileges, color TV, library, education, exercise time, conjugal visitation, recreation, etc. Not so for the victims of the crimes.)
