I got a letter from a collections agency threatning Arbitration? What is that? I'm scared!?

Many, if not all, creditor contracts carry the arbitration language hidden somewhere in the fine print of the contracts. Since many people don't know their rights, the creditors or collectors get away with forcing people into arbitration.

If the arbitration clause was in the original written agreement, which it probably was, it violates a whole slew of laws.

It violates House Resolution 5162 which amends Title 15 USC 1601 of the Consumer Credit Protection Act (CCPA), it violates House Resolution 5162 which amends Title 15 USC 1601 of the CCPA and violates amendments to the Federal Arbitration Act (S. 192).

The above is only a few of the laws that it violates. There is also case law that proves mandatory arbitration to be considered unenforceable.
Even the Supreme Court is against arbitration that a person does not consent to but is coerced into it (which is what is happening to you by MCM saying pay up or face arbitration)

Help! Debt settlement policy in the Netherlands!?

As long as the debts were with private companies, and not government or city taxes or judicial (parking fines etc), you'll be alright. Private companies do not have the power to make the police hunt you down so you won't be arrested or anything like that. The worst private debt collectors can do is seize your bank accounts or your possesions, which of course is bad enough. In the past, private debt collectors would charge ridiculous amounts for collecting debts, where sometimes the amount you would have to pay back was ten times the original amount or even more. I've read somewhere that now finally the government is putting a cap on this allowing private debt collectors to only charge a maximum of 15% the original debt.

If, as you say, the total original debt is only hundreds of euro's and not thousands, you don't have very much to worry about. If you move back to the Netherlands, what you should do as soon as you get there, is contact the city hall of the city you live in and tell them about this problem, and they will help you set up a plan to pay back your debts.

If some of your debts were in fact government or city taxes or judicial (fines), you should really try to pay them back as soon as possible.

I would suggest contacting the free legal aid of the city you used to live in (bureau rechtshulp) and have them advise you on the matter. I would suggest doing this with a letter and not with a phone call. You could also try sending a letter to the city you used to live in.

There's really no way to exactly calculate the numbers as it all depends on the steps taken by any private debt collectors and what they chose to charge you for those steps.

A credit report as used in the USA is not really available in the Netherlands as far as I know.

Need advice on insurance settlement for auto accident?

I was hit head on yesterday by an oncoming car who was totally on my side of the road and even admitted that to the trooper who filed our accident report. My car was totaled, but I wasnt severely injured, just a neck strain and a little whiplash, which is actually pretty painful and extremely uncomfortable. I know since its so clear cut and in the report that she was completely at fault that I will be compensated for medical and for my car, but everyone is telling me Id be a fool to not pursue pain and suffering and something for the possibility of future medical expenses due to the whiplash, before I sign a settlement agreement that realeases them from future responsibility. I dont want to have to hire a lawyer...I just want some advice on what a fair settlement amount might be...what should be the least I should accept (not including my car and current medical bills incurred, just for the pain and suffering and future medical)

My credit card company send my account to collection agency, what should I do?

If you're working with a Credit Couseling Service, do not listen to ANYthing the Collections Agencies tell you. I speak from experience, and I'll tell you what's going on.

The company you're working with is trying to arrange a payment plan with your credit card company. The credit card company doesn't want to do this, because they lose out on all that lovely interest, etc. So what they do is send it to a Collections Agency.

The employees of a Collection Agency are paid on commission, meaning they only get money if you make a payment. They will lie to you repeatedly, trying to scare you into paying them. Don't do it.

They can legally do this for three months, because until you've been paying on your plan for three months, the repayment plan isn't considered final. Once you've been paying for three months straight, then the calls will stop. Until then, the best thing you can do is just not answer the phone when they call. It's very nerve-wracking and horrible.

Good luck, and do everything you can to stick with your repayment plan. Bankruptcy's a horrible pain.

I have autism and I'm going to college?

I'm a seventeen year old girl who was diagnosed with autism since I was two years old. I just got accepted to a couple of universities after years of people telling me I could never attend. However, my dad is telling me that we don't have the money to send me. He is also worried about my living skills. I looked online for autistic scholarships, but I only found one. My major is computer science.

I'm getting discouraged day by day. I've been accepted to awesome universities, and I can't go. I feel my family is "stuck in the middle". We make too much for financial aid yet we don't make nearly anything to pay for college. My counselors aren't helpful and repeat to me over and over to just "settle for community college" which doesn't answer my question at all. How can I get financial aid?

Why didn't the Malays or Indonesians settle in Australia before European colonisation?

Most of northern Australia is jungle, swamp or extremely arid to desert. None of this would have been suitable for agriculture in pre-colonisation days. Even after colonisation, with more modern agriculture and imported horses, sheep, and cows, the early settlers came close to starvation many times.Probably if the early Malays and Indonesians had been aware of how huge Australia was, and that there was better land and climate conditions elsewhere on the continent, they would have extended their exploration further to the south east and eventually settled there.But it is easy to understand why, considering the parts of the country they had the easiest access to, they thought wholesale migration was not practical.
