How long before I get my profit sharing money?
I worked at a company for three years and was let go of May 2009. In my time there, I had always heard about problems other workers and ex-workers have had with their profit sharing plan, so when I left, I made sure to ask about it. They gave me a gigantic run-around and it wasn't until June of this year that I acutally received paper work for either rolling over or cashing out my plan. I was then unemployed and just had a car accident so I decided that with the amount of money, it wouldn't be a bad idea to cash out the plan and take the tax hit. Since I've submited the paperwork, I haven't heard anything from them. In fact, they've ignored my multiple emails and phone calls. I can't get a response from them at all. Anyone have any idea what a normal time frame is for getting my money? What's to say they even pay it to me? What are my rights in this position? Thanks!

Thus, you'll have to pay income tax (Federal and possibly state) at your current income rate. In addition, there's a federal tax penalty of 10% for withdrawing 401k money befor 59-1/2. So there's a good chance that you'll only net 60% of the amount you're withdrawing. Either leave the money there or roll over the entire account into another similar retirement investment account (e.g. IRA, 401k at your current employer).
