How Does An Illegal Immigrant Get Married

Can a marine marry an illegal immigrant?

Yes, he/she can.

The Marine must understand that just because he/she's a Marine it will confer no special status or immigration benefit on the illegal immigrant spouse. The spouse is still subject to deportation and a ban of up to 10 years on returning to the United States.

The Marine should check with the Navy/Marine Corps Legal Services Office on base for any further information.

Can I marry an illegal immigrant?

Yes you can
If you are convinced that he is "the one," than you should seriously consider marrying him. Once you are married you can start the process by filing the I-130. once it is approved, he will have to go back for an interview to get his visa at the American consulate. He will be denied the visa because he was illegally present in the US for over a year. At that time, he will be instructed to file the I-601. You will have to present evidence proving that you could not live in Brazil. This would include evidence of medical problems you may have, financial obligations in the US, familial obligations (i.e. caring for aging parents or disabled relatives.) and anything else that would make it impossible for you to move to Mexico. You have to prove that the hardship would be ABOVE and BEYOND the hardship that could be obviously expected. This means that the fact that you love him and "can't live without him" would not mean SQUAT to the case. The good news is that 90% of I-601s are approved. If you are serious about your boyfriend and plan to marry him and go through the long process of getting him his green card, than you might want to talk to an immigration lawyer about your options.

Hope this will work

Can you marry an illegal immigrant to keep them from getting deported?

If a person came into the US with a valid visa and overstayed it, s/he may be eligible to apply for adjustment of status (green card) through marriage. I have assisted people in the past where they came into the US on an F-1 visa, overstayed and never left the US, but fell in love and was able to apply for a green card in the US even with an expired visa. More info here: Overstayed Visa and Getting MarriedHowever, if the person is undocumented (did not come into the US with a valid visa), then getting married to him/her will not prevent them from being deported. And even if that person goes back to their home country and tries to apply for a visa, they will most likely not be able to obtain one due to a 3-year, 10-year, or permanent ban as a result of accrued unlawful presence.*I am not an attorney. Please do not misconstrue the above as legal advice.*

If an illegal immigrant marries an American lady, will that make him legal?

Not always immediately, his path will depend on whether or not he entered USA formally through immigration inspection.I’m assuming they both live in USA at the moment. If he went through immigration, basically got his passport stamped, then it is as simple as filing for Adjustment of Status. This will get him a permanent residence (green card). If he didn’t go through immigration, then he is required to exit USA and apply from his country of origin. The only exception is if he can successfully claim that it constitutes a hardship for his family, which is not easy to prove. If he exits the country, he will be barred from reentering for 3 years (for 6–12 months of unauthorized stay) or for 10 years (for more than 1 year of unauthorized stay).

Apart from marriage, what other ways can an illegal immigrant get his/her papers in Canada?

This would be a good time to consult a proper immigration lawyer. If you qualify for Express Entry (except for the illegal overstay part) you might be able to leave Canada and apply through the regular channels. I’m not a lawyer so I don’t know if that would work.Do not consult an immigration “agent” or a consultant. A real lawyer can give you proper advice with an investment of only a hour or two of their time.

How can I marry an illegal immigrant in the state of maryland ?

You can marry the same way but understand your in for a long haul because getting married does not solve the immigration status. Once you get married you can file the I-130 $355 and that could trigger a deportation. You will also need to file the I-601c form to get a waiver for the 10 year bar that way there is a possibility that the person could come back in 1-2 years. If deportation happens then the I-212 form which is also a waiver should be filed. There are other forms as well after your marriage interview you will get instructions to fill out the DS230 and the affidavit of support. Getting married will put you closer to the front of the line but the undocumented person will still need to leave the country and go back to their country for the interview. You may consider going back to their country and getting a visa to live there as well. Make sure your ready to sacrifice for them because reform might help and it might not with your situation. I would suggest you meet with at least 2 immigration lawyers and get their take on it.
