Info on American Work Visa's?

Hi there,

Getting a work visa or work authorization in the US can sometimes be very difficult, unless you qualify for immigrant based visas. The two most common work visas are H-1b and H-2.

H-1b is the only one that you could eventually apply for a Green card from. This is a highly skilled worker visa, meaning to qualify, you need to have a standing job offer, and that company has to apply for you (costs them from $3,000 to $10,000 depending on their size). To qualify for the visa, you have to hold at least a Bachelor degree (or have a very solid resume) in a field relevant to the position. This visa is good for up to 5 years and can be renewed. You could be eligible to apply for a Green card in this category, but the company sponsoring you would have to prove that they could not get any US citizen or Green card holder to fill the position.

H-2 is a temporary seasonal work visa, good for up to one year. To qualify, you must be sponsored by a company and have a standing job offer from that company. The job has to be seasonal, and located in an area of the country that has a shortage of available US workers qualified for the specific job.

For many, the process of obtaining a U.S. work visa can be very difficult. Usually, the "easiest" way is if you graduate from an American university with a Bachelor degree or more. You are then eligible for OPT (Optional Practical Training) for up to 1 year, and can take up any employment that is related to your field of study without having to have a company sponsor you. From there, it is easier to get a "foot in the door" with a company that could be willing to sponsor once your OPT expires. OPT applications cost $340, but getting a degree in the US can easily cost anywhere from the tens of thousands and into the hundreds of thousands. However, on a student visa you are also eligible to take up part time employment at your school for the entire time youʻre a student.

Best of luck!

Bad for America restricting H1B Visas?

Did you see Business Week's article on H1B visas last week? Only 2 of the top 10 companies that use these visas are American. One of the foreign consulting companies even admitted that they use the US clients as a training ground for their staff - and then send them to the rest of the world once they've made all their mistakes here.

Suppose 2 companies bid out a job to redo a computer system for a company. One bids w/ US programmers, the other w/ H1B programmers. Client chooses the lower bid (H1B). The programmers dilly around, do the minimum work required, collect their money and leave the client w/ a subpar system. At that point the client either ponies up the money to have the US guys fix it (at additional expense) or just stumbles along w/ a really bad system and is angry at all programmers.

Now remember, companies that hire H1B visa holders are supposed to pay them GOING RATE. But they don't. That's why they can underbid. If h1b numbers are increased it will drive down the salary of US programmers, which is NOT the point of this program.

With visa B-1, how many times and how long I can stay in US?

Disclaimer: I am not a lawyerAs your visa indicates M (multiple) entries, there is no specific limit. You may be able to enter the USA 366 times a year, once a day, with that visa (obviously implying you exit the USA everyday)In general, it is recommended not to stay more than 182 days a year in the USA; half the year would imply you reside in the USA, which is not permitted on a B visa. Each time you enter the USA again, the border agent will be asking you harder questions about your visit, to convince them you are not trying to reside at the USA.

Does an American visiting China need visa or just passport?

You will need a visa and a passport. Your passport must be valid for six months past your visa validity date and have at least one full page that is empty. There are several kinds of visas for China. Tourist and Business are the most common. Both come with single, double and multiple entry options. They are normally good for a 30 day stay, but you can request up to 90 days. You can also get work or student visas, such as Z Visa and X Visa. Z Visa is an employment visa and X Visa is a student visa. Both require proper documents from a Chinese organization such a school, the Education Ministry and/or the Foreign Experts Bureau. Such documents can be obtained through the school at which you are going to teach or study. The best source for info is the Chinese embassy or consulate in your area. If you do not live close to one, you should visit their websites.

What is "FNU"? is there any problem in having it on American visa?

FNU stands for first name unknown. This is an indication that either the applicant had only one name (the last name) or the person processing the application could not parse the name into its individual components.

You have to go an make the correction and give them the right first name, family name and middle name if any, if you give an a I-94 form the FNU as a first name you will have problems afterwards with yours documents in US.
I would approach the consulate first. If that is not feasible, I would ask the immigration official at the port of entry for advice on how to enter your name.

If you want to play it safe, you can complete two I-94 forms. Leave the name fields empty in one. In the other, if you do have distinct first and last names, enter them in the appropriate places in the I-94 form; if in fact you have just one name, enter it as your last name and leave the first name field blank.See the US consulate has ur first name as FNU because in Indian passport they do not clearly differentiate between first name and last name and because of this and the consulate to be on safer side they put first name as FNU, the US consulate members are confused with first name last name funda when compared to Indian way of writing the name Last name first name funda. I had the same issue and I asked the consulate who stamped the visa and they said its the Indian passport the way the name is mentioned.
SO while completing your I 94 you write down your real first name instead of FNU and it works fine because I have completed 2 I-94 since the visa was stamped and I had no issue at all at the port of entry.

SO in short,
First name : Is your real name( Ram/Shyam, Geeta/Seeta)
Last name: Reddy, etc.

If i bring my man up from jamaica on a fiance visa how long will that take?

Google - K1 Visa Process. You will have all the information you want or ever hoped for and the process from start to finish can take 8-months to more than a year.

The major qualification, besides the forms, affidavit of support and proving that you are in fact involved in a romantic relationship (photos, letters emails etc....) you will be required to get married within 90 days of arrival here in the states.

Good luck.
