How Much Is The Whole Process Of A Provisional Patent

E-filing for provisional patent - is it safe?

Hi,

I'm a registered patent attorney and I have clients that have used LegalZoom for their provisional patent filing. The applications filed through Legalzoom weren't bad, they were mostly adequate and certainly complied with the applicable rules, but they also were not what I would have done for the client. They just were not as complete as they could have been, in my opinion.

Patentwizard was created by a patent attorney, Michael Nuestel and applications filed through the software are filed by his firm, I believe. Anything you disclose to a patent attorney or agent will be kept confidential by that person. This is a professional requirement for attorneys and agents.

Thoughtstopaper claims to have applications prepared and filed by licensed patent firms, but I don't think Thoughtstopaper is a law firm. I'm not too sure about that arrangement. With them acting as an intermediary, you don't get the same guarantee of confidentiality that you do when dealing directly with an attorney or agent.

If you are comfortable doing some of the work yourself, you can save some money. I wrote a guide that teaches inventors how to write a provisional application themselves. Even if you write your own application using my guide, I still recommend a review by a patent attorney prior to filing. You can read more about my guide here:

I work with independent inventors and would be happy to give you a quote on a provisional patent application.

Good luck with your invention.

What would it cost me to file a patent application in India?

The cost of filing a patent application in India, for an individual is Rs. 1750/- (paper filing) and request for examination is Rs. 4400/-(paper filing), whereas for online filing it is Rs. 1600/- and Rs. 4000/- respectively, but the applicant must have a digital signature to do that. For small entities, startups and other than natural persons (companies/institutions) the official fees will vary.Whenever, you thought of filing a patent, first thing you will consider is the cost to file (inclusive of official fees, and attorney fees), where the person feels the patent procedures are very strict and can be solved only by the attorney, but in reality, the patent procedures are so simple and Patent office promotes IPR filing (patents, trademarks, designs etc). The attorney shall charge minimum of Rs. 5000/- for patent filing and Rs. 30000/- for patent drafting.Any inventor who has invented something new, novel, but who is financially not supported, cannot afford such a huge amount from his pocket and his inventions are not protected in due time or else go in vain if he has not filed/protected his invention. The example case Student Engineers from Engineering colleges or Technical schools. The students really invent something new and come up with the solution to the identified problem. Such new concepts are not well protected for the country like India, who has a potential of generating more than 10 laks engineers per year. The inventions must be protected for the welfare of the country, otherwise, someone from USA or Japan or any other country will sell their own patented products in India, because India is a super market for global products. To overcome the myths in patent process in India, i came across, IPR ARENA a SAAS platform, can assist the inventors to file patent applications on their own, without any assistance from IPR attorney or patent agent, with a purchase of license at an affordable cost, may be Rs. 2000/- for the entire patent filing process along with official fees.IPR ARENA shall help to file patent applications in the student/academic community and encourages more IPR filings. For more information, you may please visit IPR ARENA.

What is the process to file a patent in India? What are the fees and time required? Which government departments get involved? Is there any good 3rd party service available which helps in dealing with the patent application process?

One may file a patent application online or in the Indian patent offices located in - Kolkata (head office), Delhi, Mumbai, Chennai. In general , you need to submit these documents when filing, however, depending on your specific requirements, you may need to file some other prescribed documents too. 1. Application for Grant of Patent in Form 1 [section 7, 54 & 135 and Rule 20(1)] in duplicate;2. Complete specification in Form 2 in duplicate [Section 10; Rule 13]; comprising:Description Claims Drawing (if any) Abstract 3. Statement and Undertaking in Form 3 in duplicate [Section 8; Rule 12]; 4. Power of Attorney in Form 26 (in original)(Rule 3.3 (a)(ii)); 5. Declaration of Inventorship in Form 5 in duplicate (only in case of an Indian Application;(Rule 4.17); 6. Certified true copy of the Priority document (in case priority is claimed); 7. Requisite Statutory fees (cheque / DD).  Check the latest applicable fee schedule at Indian patent office here-Page on sagaciousresearch.comThe patent application is published after 18 months from the date of first filing. If you would like to expedite your patent protection, place a request for early publication under Section 11(A)(2) in Form 9 any time after filing of the application. Upon such request the application will be published in one month from the date of such request. There are many more complexities involved even after the filing is made related to patent prosecution, including handling the pre-grant and post-grant opposition of the application and more. So it is best recommended that a one stop service provider is contacted who can provide you with end-to-end services till the grant of the patent. You may contact us at info@sagaciousresearch.com for any such assistance.

How much will the patent process cost of you qualify as a "micro entity"?

The bulk of the cost of filing a patent application is the legal fees, not the official government fees, and the legal fees don't change based on entity size.  So, the cost of filing as a micro entity would be a few hundred dollars less than filing as a small entity.
