How To Find Out If Someone Has A Warrant In Pennsylvania

If someone has a bench warrant in one state, could that person be arrested in another state for that same bench warrant?

I have read almost all of these answers. I am originally from Indiana, and the state places a rider on all their misdemeanor warrants that it is enforcable only within state boundaries. Now, I seen almost all of the answers her are from people with law enforcment back grounds. Not to upset anyone but police officers do not spend the time and money attorneys do on an education. When there is a rider on the warrent it is placing a legal jurisdiction or enforcement on that warrent. And that warrent is then only a legal document in the boundaries of jurisdiction of that document. Outside of that it is worthless, nothing more than toilet paper. So it is my understanding that it you are out of jurisdiction of the warrent as stated on the warrent (which at the time the officer runs a check it is stated there it) and arrest you only on the basis of that warrant then they have commited a legal kidnapping and have falsely arrested you due to the fact the officer already knows the jurisdiction of the warrent and what the intent of the issueing court is on the extradition. So yes you should take care of the warrent as soon as you can, but understand that if you are checked and you are in fact outside the limits of the warrent. It is no longer a legal document and can not be enforced at any cost just like a city police officer had NO jurisdiction in another city that is not within his state. In fact if that police office from NV came to my state of Florida and tried to use his badge in a official capacity he would be arrested for impersonating an office. If the law is like that for the jurisdiction of a person what do you think they would be for a pirce of paper. And remember to alway demand (not ask) to see the warrent and to read it completely before you sign it. Some jails have been known to pass off the warrent as extradition papers just to get you to sign the warrant. Sorry to any law enforcement officer i may have upset.

However, the summary warrants can be turned over to a Constable for service, and entered in the CLEAN system as well as the local warrant data base.

Since you obviously feel that you are above the law, you would be surprised at what extent some Constables will go to in order to apprehend someone. And, since you ha ve already told a few thousand people that you don't intend to comply, you may have an added problem,. For many years Magisterial District Judges (formerly Magistrates/District Justices) did not have "Contempt" powers. they can now find you in contempt of Court, Contempt can be entered into NCIC.

While no one will pay to extradite you back across the Delaware River, it will be your time that you waste while sitting in a police station while the whole thing gets straightened out. Also, don't plan on attending any sports events or concerts in PA. On traffic stop and you are fair game.

Warrants usually state exactly what the extradition criteria are. Even if they don't, the agency that issued the warrant is called and they will advise the arresting officers as to whether or not the person with the warrant is to be extradited. Usually, this information can be obtained while the officer is still in the field with the subject. If the officer is advised that extradition is authorized, then the subject will be arrested and taken to the station until transport can be arranged. If no answer as to extradition can be found at the time, the subject will likely be arrested and detained at the station until the question of extradition is settled.

In most cases, the cost of extraditing a person to the jurisdiction of the issuing agency will be paid by that agency. Therefore, if the crime the subject is wanted for is serious enough, or if the agency has money to blow, they may authorize extradition in any of the 50 states. Or they could authorize extradition only in adjacent counties, adjacent states, or limit extradition to only the county in which the warrant was issued.

If the subject really pi$$es off an arresting officer, the officer can help things along. For example, if extradition is only authorized within adjacent counties, and a subject is arrested in such a county, the officer has every right to drive that person to the county line and drop him or her off to an officer there. In other words, don't be a jerk if you have a warrant.

If an officer stops someone, finds out that they have a warrant, and determines that the person is not extraditable, then that officer will need to have probable cause to arrest that subject for any crime before he can be arrested. Depending on the circumstances, the officer may be able to use that warrant to devolope probable cause. For example, if he is looking for someone who just robbed a liquor store, and the officer stops you, runs record checks on you, and finds that you have a warrant for previously robbing a liquor store somewhere else, that would really add to his probable cause. If the warrant was for an unpaid parking ticket, then it would be fairly unlikely that the officer could use that to explain why he felt you might have been involved in robbing a liquor store.
