It depends on what state you live in. Some states give merchants the right to recover their losses civilly, this is called a civil demand.A civil demand is a settlement through the civil court. The company you stole from comes up with a monatary amount of what your theft costs, that also takes into consideration the cost of preventing theft. The civil demand will be for more then the amount you stole.You can fight a civil demand but will have to go to court and pay court fees. If your guilty it's cheaper just work out some sort of payment plan and pay what the fee is.Also I have seen people say that this is used instead of prosecution which is not the case at all, you can be given a civil demand and still get prosecuted through the criminal court as well. Depending on the specific companies policies they will have a list of standards that will require prosecution, if you don't meet any of these standards they will give you a civil demand and release you.Once again this is all subjective to your states laws, best way to find this would be to google if your state has civil demand laws.In other words while retail theft may sound like a petty crime it can cause much more troubles then it is worth.I always feel bad for the people stealing food to support their families, but there is other options go to the stores and ask who in the area they donate food to and how to get in touch with that organization.

Am I allowed back in walmart after shoplifting?

Hi, I am 20 and I have stolen from wallmart, it was something worth $26 dollars. I got a penalty of around $200 dollars. I was not told if i was allowed back or if it would go in my permanent record :'(
Am really scared, I will be paying the penalty without a problem. They have all my information, in their computers. But I don't know where I can go to find out if I am allowed. What is their policy ? Plz help me out I am freaking out. It was my first time doing this, and i do not have a criminal record.
So am I allowed back in ? and will it go in my permanent record ? ( this incident was a month ago)

Im 15 years old and i got caught shoplifting at wal-mart and...?

I wouldn't worry about it too much. As a wild and crazy youth a friend and I stole some gasoline, like we siphoned 5 gallons out of a parked truck behind a closed business. Got busted when someone passing by called the cops.

I ended up pleading guilty in juvenile court, fined 50 dollars and also received 6 months summary probation. Summary probation just means don't break any laws, you don't have to report to a probation officer or do drug tests.

Keep in mind there's a slim chance they won't prosecute only ban you from shopping at that particular store. Remember it pretty hard to getaway with stuff like that anymore because they have surveillance cameras all over.

You got probation..this is not going to go on your record. You are very lucky. The best thing you can do is re-evaluate who you hang around with...
You are 18 years old...why in the WORLD are you hanging around with boys that would steal 300 dollars worth of merchandise? Maybe this is your wakeup call to stop and THINK about what you are doing....do you think people such as this are worthy of association? If they are stealing now where do you think they are going to be in a few years?
You are concerned about your rights being violated and little details about what happened when you admit you were with a group of boys who were in the act of stealing...IF you handle this right it may have been the greatest favor you have ever been done in your entire life.
I hope you will really think about your life, your future and as I said...who you are friends with...clearly right now you are easily influenced by others. Do you KNOW what you are going to do with your future? Do you have a plan? If you don't get up and grab your life by "the hair" and pull it in the direction you want it to go...it's going to grab you and drag you in a meaningless direction. NOW is the time for you to make some important decisions. I hope this has really shaken some sense into you and I do hope you are serious about this will not ever happen to you again...I hope you will get on track and do something wonderful with this life you have been granted and not just take up space. Got Caught Shoplifting From Walmart (Canada)?

Me and my friends decided to do it and of course we ended up being caught. We took a total of under 25 dollars, but we had clothes but they weren t from walmart. As we were about to leave, 6 under cover security people surrounded us and told us they wanted the stuff back. They took us to the back and made us give it back. They took our information (appearance, race, address, phone number etc.) We re only 15 and we were so scared, it was the dumbest thing to ever do and we ll never do it again. We re good girls, we all dance at professional dance studios, have excellent grades and we told them that. They said they wouldn t call the police, all they did was take our info take back the stuff and ban us from any walmart for 1 year. Are we going to get fined?? They never mentioned it, all they said was we can t go to walmart without a parent. Please help, my parents can t know and if i get fined i have no way of paying it i just turned 15 i can t get a job!

Is my shoplifting going on a permanent record?

Sounds like what legally happened is that the store has decided not to press charges. The total cost isn't enough for them to really bother with. This saves you from having the police called, getting a ticket, having a court date, and having to pay court fees.
The fine sounds like they want you to pay restitution. Restitution can sometimes be to recoup the cost of lost property/inventory. More importantly though its main purpose to to serve as an incentive for you not to steal again.
Basically the fine is to scare you away from stealing ever again.
The "third party" could be a collection agency, walmart's legal department, or some other semi-legal office that they are going through. Basically the store is done with you. It's now someone else's job to serve you with a fine/bill and make sure that you pay it.

The amount that you stole would have been a misdemeanor. Since you weren't ticketed it won't go on your record at all. security "officers" are not police. They don't have access to public records any more than you do. They can't put anything on your record.
You're probably in a Walmart database though. This means don't apply at Walmart or get in further trouble there. Over time your name will just get buried in the hundreds of others in the same database.
If you're really confused or worried about it you could get yourself a lawyer or call a legal line for advice. Otherwise I suggest just paying the fine and not worrying about it too much.

Can Walmart come after you later for shoplifting at the self checkout if you get away?

They absolutely can. They won’t physically go after you. Instead they will make copies of the security camera recordings and file a report with the police. The police will then be the ones to go after you. If the amount stolen isn’t enough to warrant the trouble of filing a police report, they will still retain copies of the security camera recordings. Then everyone who works in Asset Protection will become familiarized with your face and you may very well end up banned from the store. If they have recordings of you shoplifting on multiple occasions, we can end up banned for life, which will add on a trespassing charge should you go into that Walmart. Sometimes they ban people for life from ALL Walmarts. In such an instance, should you be caught shoplifting in any store, they will prosecute for both stealing and trespassing. And as evidence each and every record they have will be provided to the authorities as evidence.

First time shoplifters don't usually get banned unless you stole an absolute ridiculous amount of stuff. If you stole a shirt, you get logged in the system. If it's over a certain amount, they call the cops and file a police report and you'll probably have to go to court. Trespassing (which is what “banninng” is called internally) is only used as a last resort usually. If you're in the store stealing all the time or really big values.
