Those funds will later be deposited back into your account and the actual transaction (usually the same amount) and this is the "settlement". The only time the settlement is a different amount than the pre-authorization is if there was a tip added onto the charge at a restaurant, or extra charges at a hotel.

Should I accept a $500 settlement from an insurance company for a stiff neck suffered in a car accident?

My advice: Don't settle until you get fully cleared from a physician and consult a lawyer. Injuries from accidents may be masked and could arise much later as very serious in nature. This is not to bleed the insurance companies. It's to make sure you are not hung out to dry.

This question can only be answered by the contract your signed. But based on what you said in your question, at 40,000 the lawyer would get approx. $13,400 and you would get about $26,600.

OF NOTE: If the contract says you have to pay medical out of the settlement depending on the contract, the state and a few other fine tuned things, the lawyer can take his $13K, then you have to pay the bills out of your share of the settlement.

Also of note, you have to pay for the little things, filings, postage, witnesses.

Long story short I'm still making payments on my car , so what's exactly going to happen now ? What will happen with my payments and my insurance?
