Can a builder charge both the GST and stamp duty for a flat under construction?

GST and Stamp Duty are 2 different things. As per the GST law the projects under construction attracts 12 % get of the basic cost of the flat . The builder is liable to collect the 12% GST from the flat Buyer of a under construction flat and pay it to the Govt.For a Ready Possession OC received Project there is no GST.Since the GST of 12% is very high and is affecting the overall cost of the flat, and also it is impacting the already slow real estate market therefore many builders are absorbing 5 to 6 % of GST and are charging only 6 to 7 % of GST on the basic flat value as they get GSTn return upto 5 to 6 % of GST refund as input tax on various materials used for construction , which they pass on to the buyers.As far as stamp duty is concerned it is a respective state govts tax and while registering the sale agreement you have to pay stamp duty as per the ready reckoner rates of the respective states and registration charges.Therefore it is builder who charges GST from Buyer and pay backs to Govt. And It is the BUYER who pays stamp duty and registration charges to govt.
