What is a reasonable injury claim with an auto accident?

Howard L is absolutely correct, there is no "magic number" that will correctly reflect what you should be paid. It is a completely subjective figure that is based in part on how severe the accident was, your treatment and management of the injury, how it effected your daily life, wage loss, and quality of life. Ultimately, the major issues are severity of injury and duration of treatment and effect on lifestyle.

Unfortunately, with soft tissue injuries, there is very little objective evidence available to prove your injuries. Unless you had bruises or other visible soft tissue damage that was photographed, the only evidence of your injuries are your statements, and that's all subjective.

Also, you need to realistically figure what your time is worth. If you work at McDonald's for $8/hr, and you worked in pain for a week because you couldn't afford to miss a paycheck, that time is not worth $5,000. Maybe it's worth $500. Maybe it's worth $250. Maybe it's worth $1000.

The thing to keep in mind is that it is your adjuster who is determining the value of your settlement, based on information that you provide. If you have an antagonistic relationship with your adjuster, than they will have very little incentive to use their leeway to provide a higher settlement. It's up to you to prove that what you're asking for is reasonable. And yes, $3000 might be on the low side, but $10000 is probably on the high side. Be prepared to settle for less.

Comparing your accident to others is not an accurate way to gauge what a claim is worth. The circumstances of each accident and how an individual responds to an injury is different.

Insurance Settlement Claim from Car Accident?

Hey Guys,

I was in a car accident November 18th of last year. I hired an attorney in January and I have a good case. It seems like it's taking forever for me to get the money that is rightfully mine. How long do these kind of cases last and when should I expect my claim to be settled? I need the money now so I can start my life. Is there any way to speed up the process and also, could I get loans from my lawyer if he KNOWS I am getting a big settlement? He says he's just waiting for Geico to settle. I am really growing impatient and I need the money ASAP.

Thanks in advance!

After a car accident 2 years ago, I still have back and shoulder pain, and I’m only 22. Is this permanent?

I will address this issue in general and not specific to you. I will also assume we are talking about muscle pain whose reason is mysterious. It is hard to come to terms with such situation especially at your age. I am pretty sure you tried everything they tell you to try but you got only temporary relief.Pain is felt when some cell clusters in your muscles are not properly functioning. What I mean here is that in order for a cell to function properly it must receive nutrition oxygen and get waste removal services. When this stops from happening, the cell and the nerve endings around that area are bathing in waste materials produced by the cell cluster. This irritates them and effectively create that pain feeling you may be experiencing. In order to remove the pain you need to remove that waste and of course keep removing it as it is created. It is a known fact that nutrition oxygen and waste are delivered to the cells over your capillary network. When the blood stops flowing into an area, then there is no waste removal. All you need to do is get the blood to flow back to that area. You could do it using specifically targeted exercising. But this is hard to do because you or your doctor does not know what exercise you need to do because they do not know the exact location of the cell cluster that needs treatment. The best your doctor can do is hand you this standard exercise sheet and wish you luck. The instruction on this sheet are quite sketchy and you may or may not get the movements correctly. This is another set of problems. There is however a new technology that allows the blood to flow back into the cell cluster. The action is called blood perfusion. It is easy to use. Just place the device over the pain area press on to activate its healing power. I had an accident over 5 years ago at work. Am I still able to make a claim?

According to the Legal Law, if you have been injured or you have been involved in some car accident at work, you can make a compensation claim within 3 years of that accident or 3 years after you discovered that your injury (either it is a physical injury or some mental disorder related to that accident) is related to that accident. In your case, it’s been 5 years and it would be so difficult for you to keep the relevancy of your injury or your car damage with that accident that occurred 5 years back. But still, if you think you can prove the relevancy of your damages with that accident, you can consult any well qualified and experience personal injury solicitor regarding your case. This is the reason, why it is always advised to file accident claim immediately after the accident irrespective of the fact whether you got any injury or not.Read more at Accident at work claims

Two months ago my mother met with a slip and fall accident. I want to file a case for compensation for her injuries. On what basis will the worth of the claim be decided?

Slip and fall accidents are one of the most common types of personal injury. These can occur when one goes through indoor flooring that is being polished, waxed or washed, and there are no adequate warnings; a wet indoor area is not properly closed off; indoor floor space was not properly cleaned or cleaned during periods of high foot traffic; spilled liquid, food, or other substances was not properly cleaned and no warning signs were put up; poor flooring conditions; poor stairway maintenance; lack of adequate lighting, particularly in hazardous areas; and lack of salt or sand on slippery surfaces, among others. These conditions typically arise from the negligence or fault of another party who was tasked to keep the area safe for use. If such injury occurred due to said negligence, you may be eligible for a slip and fall personal injury claim.Much like other types of personal injury claims, damages that may be recovered from slip and fall injuries can vary depending on the severity of the injury, the resulting impairment, if serious, the cost of the ongoing rehabilitation or medical care required, and lost wages and subsequent lost or diminished capacity to continue earning an income as a result of the impairment or disability that the slip and fall injury caused. It’s important to note, however, that each case is different due to their extenuating circumstances. That’s why, if you would like to know how likely your personal injury claim will progress and its possible outcomes, it’s best to consult with seasoned personal injury lawyers so they can give you a detailed assessment of your case.

How long does it take to settle an accident claim?

After a person has been involved in an auto accident and called in a claim to the insurance company, he or she is likely to wonder when the case will settle. A person can be in a sort of limbo as he or she waits for the settlement to occur. For example, he or she may have incurred significant medical expenses and be without the funds necessary to pay them. At the same time the injured individual may not have been able to return to work, leaving him or her in a precarious financial position. A lawyer can explain that there are many factors that affect the value of the settlement. Many claims that are clear-cut and are solid on the question of liability are settled in a matter of months. This is especially true when the claim involves medical damages that are clearly and objectively established. However, other claims may take years before they settle and may require the threat or commencement of a lawsuit before there is any forward traction in the case. Additionally, some cases do not settle at all. If your find it difficult to make claim or don’t know how to make claim in a proper way, then claim adjuster can help you to settle your claim in a better way. He works as a mediator between you and insurance company. He explains you the process of making claim in details and help you recover the amount that you deserve.
