If A Tenant Agrees To Pay The Landlord For Damages Will This Avoid The Landlord Suing The Tenant

Can the landlord sue me for fire damages after the insurance company paid them?

I had a grease fire at my house last year, cookin fries... I rented the home, we got the fire out just before it got out of hand. It burnt up the stove, cabinets above and the counter top on one side of the stove. The fire department showed up just after the fire was put out the insurance adjuster arrived just after that. The insurance claim was for around $10,800 and i had some law office harassing me with phone calls as a debt collector and I told them that is what insurance is for, it was an accident, after several months of these phone calls i told them I would just have to see them in court. They finally stopped calling and just today I received a letter from a different law firm demanding payment for the same incident for $11,800. The landlord had insurance on the place, she received a check for the damages, and now that same person wants to sue me for the damages. On top of everything I payed her deductible for the insurance claim.

I also need to point out that with the first law firm it was the insurance company that was coming after me for the money, with the second law firm it is the landlord coming after me.


Any advice Please help!


I dont feel like I owe them anything, thats what insurance is for, part of my rent was to cover her insurance costs.

Can your landlord sue you for damages to the house if there was no lease and they kept your security deposit?

I have rented a house for the last 8 months from a freinds parent and we never signed a lease. Over the course of the time we lived there the owners did very little to nothing to fix any complaints we had they only quiety accepted are money. Before we moved out they made it clear that they would keep our security deposit because they claimed we were "Scumbags and ruined there house" but any damage done to the house had already started before we moved in or was very minor. When we did officialy move out we left the floors, sink, stove, and counters a mess out of spite and also left somethings in the house but we removed all the trash. The landlord now says they want to press charges for us ruining the house, do they have the legal grounds to do so and if so what can i do to help my situation.

You are not supposed to know the nitty-gritty of any law to file a complain at any police station.Go to the police station asap, file a complain (just state your problems and attach copies of all possible documents related to this matter)and let them interfere. Initially, they would listen to both the parties and ask for some mutually agreed settlement.Remember to have your complain acknowledged by the police. And , your complain should be in harmony with the rent agreement terms. Meanwhile, try to fetch some evidence before filing a complain,so that you could prove your points.At this tender age you should try your best to avoid any serious complain against your name. As stated, they have an upper hand on you. So, please choose the minimum resistance path. Your priority should be to settle the issue in the best possible way rather than teaching them a lesson.

Landlord/tenant, mold problems...can i sue?

We have been renting a home since June, in September there was a mold problem from a pipe in the garage. Our landlord ripped up the wall and left it exposed for two weeks mold and all. I am pregnant and at the time my son was 13 months old. (btw, has asthma and eczema) We had a mold tester come in today and everything in the walls were bad. And he was upset about the walls being opened and exposing us to it when we were living in the home. We have had problems with every room in the house with mold in the corners, even with me cleaning it everyday. I found mold in my closet yesterday that ruined 3/4 of my shoes. Can I sue for him not taking care of the problem and for us paying rent in an unhealthy dangerous environment? I just want our money back.

Absent specific contractual terms, I don’t believe that your landlord is going to be obligated to engage in self-help and use your deposit (which is insurance against apartment damage) as a de facto final rent check. There are certainly landlords who do this (I once rented a house that was being remodeled after I left, and my landlord took the security deposit in lieu of a final rent check because adhering to the literal terms of the lease was pointless), but voluntarily agreeing to do something is different from being legally obligated to do something.The truth is that you have almost certainly breached your lease. Your landlord is entitled to a set number of monthly payments plus a security deposit, so your failure to pay your rent as agreed is a problem. As a practical matter, considering that your landlord is holding a month’s worth of rent, it would be difficult to see how she could claim to be damaged (assuming your claim of no damage to the apartment is correct), so it’s likely not worth anyone’s time to bring a lawsuit. However, you describe the landlord as a “notorious slumlord,” and generally speaking, slumlords tend to be a litigious group, that is, the kind of people who will bring the occasional weak lawsuit in order to scare other people into compliance or prevent them from asserting legitimate claims. A lawsuit brought against you would be time-consuming and expensive, and could have a long-term impact on your creditworthiness. It’s not a risk that someone in your situation should likely be willing to take.Your offer of compromise was reasonable, and I think your landlord is being ridiculous, but unfortunately, your landlord has the right to be ridiculous. I’d pay my rent and then work like hell to make sure my deposit was refunded in full ASAP if I were in your shoes.
