What does it mean if a judge admits a will into probate?



"Admitted to probate" means that the will has been "proven." That's what probate means. A decree of probate is accompanied by a grant of "letters" to the personal representative of the estate -- executor or administrator. The letters enable the executor or administrator to open a bank account in the name of the estate and to collect the assets that were the property of the decedent. After the assets have been collected and taxes and bills paid, the estate is distributed in accordance with the will or intestate succession statute and the executor/administrator files his or her final "account" with the court, and the estate is "closed."

A party that is cited to show cause why the will should not be admitted to probate and fails to file an objection will not be allowed thereafter to contest the will, though she could object to the way the estate is being administered.

How long does it take to recieve inheritance money after the closing date?

My husbands Aunt passed away 7 months ago and left us some money. All of her assets have been sold and finalized. We are currently in the 90 day waiting period (where anyone who is owed a debt can submit for payment) and the end of that period (or the closure date) is coming up quickly. How long after the closure date until a check is issued with the balance (thats due to us as beneficiaries)? I have never had anyone pass and leave me money before so I dont know what to expect. We were told a check would be issued after the required 90 day period and when that period would end but werent given any additional details. If anyone has reliable knowledge on how this works Id really appreciate it. Thank You!

If there is no will then the law of that jurisdiction will decide the order of who can be executor and who the house will pass to.If one is living in the house at the time of death of a parent and will not eventually inherit the house as an individual then the personal representative may ask them to leave or to start paying rent for the benefit of living in the house while a transition is made.
