If Someone Gets Married In Mexico Is The Marraige Valid In The U.s

When a Mexican citizen gets married to a US citizen, how long do they have to wait to sponsor their spouse to become a US citizen?

They don’t have to wait at all. The citizen requests admission of their spouse, and the spouse applies for a spousal visa, permanent residency (PR), work permit (green card), and travel permit (508) all at the same time. This is, you complete an I-130, I-485, I-864, and I-693 with all required attachments in one package and send it to USCIS. It will take about a year for USCIS to process them - which is a PINA because that means you have to redo the I-693 (medical exam) if its more than a year old.The immigrant spouse will then get a temporary PR, work permit (green card), and travel authorization. Six months after that, you’ll have an interview and get a “Condional” PR card. 2 years later, another interview, and the “conditional” status is removed.Three years after the initial PR was granted they can apply for citizenship. (Just to be clear, the time is six years for most immigrants, but spouses only need three.)

If I got married in Mexico, but lived in the US when I got divorced in Mexico, do I need to get a divorce in the US?

I expect so. Here in Canada, we recognize a marriage in Mexico but not a divorce. The reason they taught us in law school is that marriage is inherently good for the state, so laws are liberal with regard to recognizing marriages. But divorce is inherently negative, it has major implications for changes in property rights and custody of children. So if you want to be legally divorced, you have to jump through the government’s hoops.

Im gettingmarried in mexico with my fiance im a US citizen were getting married in puebla, mexico..?

You need to get a license. You can pick one up at a local government office a few days before the wedding.

You also need a blood test for RPR, and HIV and Thorax (chest) X-rays. It is recommended that these tests be done in Mexico two days prior to your wedding. Cost of the tests average $125 per person.

Also, Mexico does not recognize religious marriages. You must have a civil marriage held in a government office if you want the marriage to be recognized in the United States.

Each state has it's own requirements.

If I get married in another country am I legally married in America?

If the marriage was legal when you got married, at the time you got married, then you are 100% married in the USA with only a couple exceptions.... homosexual marriage and polygamy (if you are not the first spouse).

If I married my husband in the US is it legal for him to remarry someone else in Mexico before we are divorced? If it's not legal, what can I do?

I should think that a legal marriage is valid anywhere in the world. If you have married in the legal way, there is absolutely no way that your husband can get away with getting married again, unless he lies. Which again, it would make the marriage illegal.

Is an American marriage license recognized in Mexico between an American citizen and a Mexican citizen?

Most countries accept marriage certificates issued by the civil authorities of other countries under a doctrine widely known as lex loci celebrationis: the marriage will be accepted as valid, everywhere in the world, if it was legally valid under the law of the place in which it was celebrated. There are some obvious exceptions to this. Only some nations will recognize marriages between persons of the same sex. Two countries (Vatican City and the Philippines) will not recognize a marriage between two parties, either of whom had previously been married to anyone else where that prior marriage was not terminated by death, as these two countries do not allow for divorce.Marriage licenses, however, are typically only valid in the jurisdiction for which they are issued. A marriage license is a document which certifies that the parties are eligible to get married. A marriage license does not prove that the parties are married (and in fact to get a marriage license generally the parties must not be married, to one another or to anyone else). Once the marriage authorized by the license is celebrated, a marriage certificate will generally issue, and that certificate is what will be acknowledged basically worldwide. In the specific case of Mexican acceptance of a marriage certificate issued by the civil authorities of a US state: such a certificate will be accepted by Mexico as proof of a marriage, provided that the certificate has been properly certified by its appropriate issuing authority, has been apostilled by the Secretary of State of the state in which the issuing authority sits, and is accompanied by a certified translation into Spanish. Mexico has recognized same-sex marriage since 2010, and so a same-sex marriage celebrated in the US will be recognized by Mexico. As an aside, you are incorrect that an American needs an American marriage certificate for the marriage to be recognized in the United States. Every US state observes lex loci celebrationis and will accept as valid any marriage certificate issued by any civil authority anywhere in the world as long as the marriage was legal under the law of the place in which it was celebrated. If the certificate is not in English, it may be necessary to obtain a certified translation. US states generally do not require the formality of an apostille on foreign marriage certificates.
