I GOT INJURED AT WORK?

if they offer light duty and that position is something which you are capable of doing and it does not aggravate the injury You are required to take it... and they are required to Pay you wages (at your original rate for as long as you do the 'light duty' job... also the hours of of the light duty must also be within reasonable range of the hours your worked at your normal position

if the pain is such that you cannot tolerate even light duty, then you can reject it and should be applying for COBRA

in either case you should be getting money from somewhere until you are officially released from the Company (which they will not do, because if they fire you for injuries received in the course of duties that opens the door for a major civil suit) or return to your original position

if you are not performing some function for the company, they are not required to pay you...

i'd suggest using any sick/vacation days to cover time missed to date, accept light duty and stick it out... that and stock up on ibuprofen/advil/aleve or your favorite OTC Pain reliever

-- I was in this boat a few years ago 90% of my light duty was shredding reams and reams of documents-- no I didn't work for Enron-- so I sat by a shredder all day and bagged shredded paper-- someone else had to haul the bags away and got paid full wages

note.... if it was not your job to pick up the box: and they Told you to pick it up, you could sue them for making you pick up the box... but if you Chose to pick it up, they could fire you...

I used to love working out. After a year-long injury, I hate going to the gym. How can I get back into my routine?

I am assuming that you have completely recovered from the injury and are now fit and healthy to do weight training.A lot of people hate doing leg workouts. Do you know why? Because they are not good at it, because they can't lift heavy. This is because they have invested very little energy and time in the past on legs and now they are bad at it compared to what they can do with their upper body. We all have that one exercise we love because we are good at it and we all hate that one exercise we can perform well and we like to avoid when we get a chance.Your case is similar. Legs are your new ability to lift weights. Upper body is the ability you had before your injury. You are comparing your present with your past and this is not allowing you to enjoy your present.Set realistic goals. They may be really low compared to what you did before, but keep them real. And hit them regularly. Enjoy those small increments you make in your strength. Try out new variations which you never did before, that way you don't have a baseline to compare to. And try and avoid comparison with others. They did not go through what you did.It's a bid deal to get back and to give your best effort. The results will follow soon. I had a brain injury 14 years ago and have tried over 30+ antidepressants, nothing works. Is there something else I could try?

My ABI was 2006, leaving chronic pain and bad sleep. Depression is par for the course. Antidepressants tend to moderate serotonin or dopamine uptake, as if inhibiting the brain dulls the sadness.Meanwhile, adrenalin highs seem to be in a league of their own. I only require one of them per day. Weight training works, if you get good at it. Running creates a high when listening to good music. But exercise is tougher to keep up, when you are my age.The other thing that can help is certain strains of marauana, but that route takes a lot of trial and error; so go to Amsterdam for a week, where testing is safely facilitated. Perhaps find a strain that gives a body buzz, while letting you think straight.Also, get out of the house every day. Nothing is more important than thid Golden Rule. You can drink gallons of vitamin D every hour and still not compete with the sunlight effect.Good luck my friend. There are many like us, unplugged from our pre-conditioned social normality and forced to redefine ourselves, and our lives. We don't curl up in a corner, because we are forced to find the courage not to.I suspect you will like Amsterdam this summer.

Should i sue my last employer for work related injury?

If you are still at the place of employment, you need to file a workers compensation claim, and be seen by a physician.

Right now you have described symptoms, which might be the result of a repetitive motion injury, but at the same time, a full history and examination, might find another cause for your complaints.

Your question sounds as if you no longer work for this company. If you did not file a claim while at the company, you might be able to file a suit, but might also have difficulty proving cause, since you did not file a claim and get seen while working for the employer. It is often difficult to prove this condition did not start after you stopped working for the company otherwise.

Also, do not accept their company assigned physician if you can avoid it. Get your own physician. If you have a repetitive motion injury, you likely need an electromyelographic and nerve conduction velocity study to fully diagnose the extent of the problem. Try to see a neurologist who can perform these examinations.

EDIT: Contessa would be correct if this was a single accident injury. However repetitive stress or repetitive motion injuries happen over time. You do not have a 24 hour reporting window, nor would there be a witness, except that someone could confirm your job description. You do however, need to be seen while working for the employer under their Worker's Compensation Insurance Coverage. In this case you would be entitled to medical care, and for coverage for wages if you could not work. Remember, if you retain an attorney for this, while they may get you some compensation, they would also get a percentage, usually 25-33% of whatever you recover. If the court found that your medical bills should be covered, then the attorney would get 25-33% of the amount meant to cover your medical bills. For this reason, several attorneys I know no longer take Worker's Comp cases, except as pro bono cases; they feel bad taking money away from people who need it for medical bills.

3 years post injury, continuing chronic coccyx pain?

The doctor you'd need to see is an orthopedic specialist or surgeon. There are non-surgical treatments you could try, and which any decent doctor would suggest you tried first. In fact, removal of the coccyx would be the absolute last thing they would suggest, and that only after everything else failed and you were in pretty much chronic pain. The first thing they would suggest is probably the most obvious- which is that you avoid sitting in positions that cause the pain, avoid sitting on hard surfaces, and consider sitting on cushions or a donut to provide padding for the tailbone, and use pain relievers to control the pain when you can't do the above things, or they don't work. You could consult an orthopedic doctor regardless though, to see if the way it healed is the reason for the pain. It's possible that it has entrapped a nerve, and that it could be repaired. I would not recommend surgery as a first course, nor would any decent orthopedic surgeon either. While it might end the pain, it might very well not do it at all and could also leave you in more pain, more often. You can have complications later on, like the collapse of your pelvic floor, which would leave you in pretty bad shape as well. There are things that can help you short of removal of your tailbone, and you really just need to see the orthopedist to see what the condition of things are, and discuss the options available to you. I've only seen one coccyx removal though, and that was to remove a tumor. So I don't think surgery is something you'd really want to do just yet. But see an orthopedist, and you should get some useful help.

Can a MRI tell aprox. how long ago injury occured?

Help please hurt my knee at work in Oct 06. just went 2 Ortho Doc & he is setting up a MRI. Will the MRI be able 2 show prove how old injury is? Think my boss is trying 2 get out of it being work related. My boss has it in 4 me anyways & I think he is quote "trying 2 find legal way 2 get rid of me & other girl" in our dept; several guys in our dept has told us he has made that exact statement, we are scared 2 go 2 hr because he gave us both a bad eval he claims we are not able 2 do a certain task in our job plus there are a couple of the guys that cant do this task either but he did not hold it against their eval. I have a long list of things he has done to me that I let slide because I need 2 keep my job he just keeps giving us both a hard time. need to know if the MRI will show that it was due to the work injury or I have waited to long to hold the company responsible. went 2 the company doctor when it first happen but he didnt help much. thanks for ur input!!

Do I need a tetanus injection today if the last shot was 3 years ago?

It depends on your wound type and whether you recieved your full course as a child. I assume you did receive your full course. However if you recieved your booster 3 years ago you don't need any shot even if the wound is deep. You need a booster if injured 5 years after last booster.

Can I ever recover from the knee injury that took place 5 months ago? I still can't play football.

The answer is most definately, but you might experience some knee-pain and having a larger chance of getting arthritis. Of course all depending on the severity of your knee injury.I personally ripped my ACL in my knee 9 years ago playing soccer, which took my a while to get over, due to improper diagnosis and a lack of rehabilitation. I am now back at it, playing American Football, and my experience is that, the more I train and lift weights the less pain I experience in my knee.It is possible to get back to full strength again, by good rehabilitation, determination and acceptance of a little pain. Find a good fysiotherapist if in doubt about how to rehabilitate your knee.If you still doubt the possibility of you getting back, watch some videos about Adrian Peterson, the guy tore both his ACL and MCL at the same time, and came back better than before the incident.
