Can I sue an insurance company in India for fraud?

Reason:- I bought an insurance policy from a reputed company, yesterday i tried to login my account, but details like phone numbers and email id were different/of someone else.To login an account they send OTP on registered mobile number or email id, but both were not mine. I sent an email to the company but there response was,we can't help you sir, this is not your registered email id.So, now person who has details updated there can access my bond papers, my details, my documents and also can see my medical history on the site.Any suggestions?

You could sue a ham sandwich if you file the right papers and pay the fees to do so. BUT that doesn't mean that you will win your case, just because you sued.What false information did they give you? Was it verbal or in writing? If its verbal you can't win because that becomes he said he said & you sre no more believable than the company rep. Can a car insurance company charge for adding a non-driver?

by law your are suppose to inform insurance companys any licenced drivers in the household otherwise if they really wanted to they could cancell you for misrepresentation (this would then stay on yours and your wifes history for 3yrs or so depending on state)

They cant charge you more as a penality for not informing them, but will add you if you do have a valid licence and the premiums could go up if youve had any tickets (most states 3yrs) accidents (most states 6-10yrs) If your lic has been suspended or lapsed you should have no worries as they cant add you without a valid lic.

Two options you can look into is:
1. go to the ministry and ask for an abstract or lic status
this will give you the status of your lic and ticket info
2. Give your agent your information but ask to sign a 28A
this has to be signed by yourself and your wife to state you will not drive the veh. and this way they dont have to rate you on your wifes policy

Can you sue an insurance company that does not have the funds to settle your claim?

Honestly, that should never happen. Insurance companies are required to maintain sufficient reserves to meet the policy limits of their clients. If an insurance company becomes insolvent, anyone to whom they are contractually obligated to pay monies would have a claim against any liquidated assets but there are many different factors that determine who gets priority of payment and if the money runs out before your part of the line gets to the front, you could conceivably not get paid and have little to no recourse. How can you prove insurance fraud?

My mom was recently at a stoplight, and the driver in front of her put reverse and barely bumped the bumper of my moms car. My mom got out to see if everything was okay, and the lady started screaming at her, saying it was her fault. A man got out of the car and threatened to shoot my mom, and the woman called the police. The police came and said nothing happened, nothing happened to both the cars, nothing happened to both drivers, no injuries were sustained, nothing. They didn't even fill out a,police report, because no ambulance was needed. My mom told the police about the man who threatened to kill her, and the police said there was no man. He had left the scene. So, the lady put in a claim, and the insurance paid without investigating what happened. So now, today my mom got served with papers saying she is being sued because the lady sustained "severe and debilitating injuries costing her over $100,000 in medical bills."
How can we help prove this is fraud? I really need help, my mom is freaking out ):
