You generally don’t. Opening a bank account in the USA requires you to demonstrate identity, have a valid tax ID number (SSN/EIN) and usually residence in the USA. Either personally or operating as a business.A visitor to the USA cannot open a US bank account unless they have an EIN/SSN and other documentation required by the bank to prove who you are and the reason for doing so. You’ll need proof of business incorporation or foreign residence along with the SSN/EIN and your passport. Even then most banks will not do this.You will need to walk into the branch of the bank itself and talk to them. They will provide the requirements. Most visitors to the USA will not or cannot meet them.

You can very well get the US Bank account opened in the USA when on B1/B2 visa. Most of the banks allows checking account. My siblings who visited me last year on B1/B2 visa from India opened their accounts in Wells Fargo and Chase. Both has the requirement to keep minimum balance of $1500 on the daily basis. Interest rates are almost zero and they deduct federal taxes from whatever interest earned. Most of the banks are expecting that one will keep the account opened for at least 6 months. If they feel the account will be closed in less than 6 months - they might refuse to open the account. Try to bring at least 2–3 forms of identification(Passport plus Driver’s license or any other foreign national ID) for the verification purpose.You will get 3–5 temporary checks along with the debit/ATM card this way you don’t have to carry cash with you.

If illegal immigrants could "just do it legally" then why do they risk their lives to come here illegally?

people seem to think that it is a simple, easy matter for those who immigrate illegally to the US to come thought the proper legal channels. well if it is then why are so many immigrants risking their lives to come illegally?
why cross through some of the most dangerous parts of mexico to come here legally, if they could have just done it legally?

Can I open a bank account in the US banks if I am traveling there under a B1/B2 visa?

It can be a simple procedure but depends on bank acceptance. I have a B1/B2 visa and have been travelling on and off for past 9 yrs; originally on the ESTA system but for past year on B1/2. I opened a US bank account 1 yr ago, as I have rental property and also an owned property that I stay in. The bank will ask for a Individual Taxpayer Identification Number (ITIN) this can be appied for online with W7, I got mine via visit to US Embassy in London but I believe that is no longer possible. Identification,  Passport, Licence, proof of a US address is needed.

What happens if an illegal is caught with a fake social security card?

The Mismatched social security fund received over 9 billion dollars last year in FICA paid mostly by undocumented people using false cards and numbers. They can't get out of paying FICA nor can the employer which adds up to over 15 % of the check. They can claim higher deductions and play less Federal and State but most of them will never get any of this money back. Some undocumented people work using an ITIN and they are not supposed to do this because it is not the same as a Social Security card or number. It has the same amount of digits and is used if they start a business here in the US they can pay business taxes. Earlier many undocumented people used the ITIN numbers to buy homes currently they cannot do this.

The US Supreme Court ruled in 2009 that you will not be charged with identity theft if you are using false documents just to work. What kind of mixed messages does this send? I guess the United States wants and needs the billions collected. See the two references below.

After they are caught with a false card they can be deported if they are here unlawfully but many times they are not even deported. It is much more serious if they are caught making false ID than using it to work. If they are using false ID for fraud the charges are much more serious.

NO. They have “diplomatic immunity”, however many officers have a “need” to be paranoid about potential immigrants and those who overstay their visa and become public charge on the US soil.And BTW, you do not become an illegal immigrant if you got to the US legally and overstayed your visa, there are many options for you to stay in the US, one biggie being getting married to a US citizen, or apply for refugee status or asylum, or approach an immigration attorney to have your case sorted before you get deported (or to avoid deportation).Take care and have a lovely day !!!
