Is There A Self Defense Law In Nc

Is killing someone in self defence legal?

In accordance to US laws, generally:No, it is NOT legal to shoot someone with the express and singular purpose of killing them, even in self defense. However, if you feel like your life is in danger to the point where major bodily harm or death may occur, and you use lethal force (I.E a firearm in this case) and defend yourself. If they die because of said wounds? That is generally ruled and justifiable homicide. For example, take these two situations:A: A man breaks into your house at 3 am and you grab a handgun, and put a controlled pair into his chest, after which he falls over and stops moving. You then call 911 and then you wait until police get there.B: You wake up at 3 am to someone breaking into your house, you grab your handgun and proceed to put a controlled pair in his chest. He goes down. You then keep firing into his chest until you are out of ammo. You then call the police, report it, and have them come to drag the body off.Situation A, assuming he dies, is justifiable homicide. Situation B is murder. In the US, you may use deadly force to stop an attacker up to a point. You don't shoot to kill, you shoot to stop the threat, once that threat is neutralized and no longer an active threat, your hands are tied. You have to stop.Edit 1: Some clarification that I should have originally posted, and brought to my attention thanks to A.J. Rosingana. If you need to use lethal force in a situation, it's lethal force. It's expected that an outcome of that may or may not be your assailant dying. Unfortunate as it is, that is the reality of that kind of situation. You shoot to stop the threat, but you dont shoot them enough to ensure they die like in example B.

What is really the law on carrying stun guns in NC?

I've researched and found it's illegal to carry a concealed stun gun in NC. Does this mean that I can carry it around if it isn't concealed? For example, if I carried it openly in my hand or wore it on my belt, would/could I be arrested?

I live by some very rough areas, and I'm not looking to bring a stun gun everywhere or look for trouble. But if I do want to walk somewhere close at night for whatever reason, I'd like to have it with me.

The stun gun I own is a monarch 1.3 million volt stun pen with a LED flashlight.
THIS QUESTION DOES NOT PERTAIN TO TRANSPORTING STUN GUNS IN AUTOMOBILES! It's only about being on foot.
Please don't tell me I should get a concealed carry permit because I already know about the pros and cons of having one and can't afford a handgun right now. I just want to know about the laws pertaining to carrying this stun gun outside of my home in Greenville, NC.

What self defense items can I legally carry in my car?

As a general thing, there are lots of items which might be pressed into service as weapons and would not be illegal to transport.   Sporting  goods, for instance.  A bat, a ball, a glove....  A hockey stick...Various tools.Building materials.... A few hardwood dowels along with a reciept from the hardware store...      All innocuous items that can be transported legally and can be used (if you have some skills) for self-defense.But.... Be aware that introducing a weapon into any self-defense situation changes the legalities involved.     You need to be aware of at least the basic principals of self-defense law and more importantly, how it is handled in your area.Using a weapon raises any confrontation to the level of "deadly force" even if you can show you did not intend to kill the other party."Deadly force" is a legal term...."Force which may cause death OR serious injury."      Serious injury might include broken bones, internal injuries, etc.   Whacking someone with a baseball bat and breaking his arm is deadly force. Are you legally justified in doing this?       Better think about it.

What would happen if you claimed a common law right to travel at a North Carolina traffic stop?

You would receive a citation (which you could elevate to an arrest by being belligerent).Since police officers are not allowed to decide what the law should be, they will issue the ticket. Even if you have a very compelling argument, you are wasting your breath. But do not fear! Your citation will include an invitation to an audience with exactly the proper person to hear your claim, and who is empowered to make a decision based upon it if meritorious. That person in the judge before whom you will have been summoned to appear. Your traffic citation has the details. The system is that you meet with that judge in that court at that time and date, and explain it to him. Then you listen as he or she explains some things to you.And depending on how all that goes, he may find you guilty, and assess whatever penalty is deemed appropriate. And with luck, everyone goes home either smarter, or at least entertained.

Is it legal to shoot a burglar in your own house? Does it matter if their back is turned to you?

In Texas, it generally is legal to shoot a burglar and it doesn’t matter whether his back was turned, inside your house.Someone with his back to you could be picking up something to brain you with, or be heading to the kitchen to get a butcher knife, or going down the hall for your wife or children.According to The Castle Doctrine, he has already demonstrated bad intent towards you and your family by breaking into your habitation while you were in it.Shooting a burglar in the back is sometimes called “Preventative Self Defense”.Not long after The Castle Doctrine was passed, a man in San Antonio found two men in a spare bedroom after having broken in through a garage door.He killed one in the bedroom with a shotgun, while the other pushed past him and ran out a sliding patio door into the back yard.As he was trying to climb over a six-foot wood privacy fence, the homeowner walked out and shotgunned him in the back, killing him too.No charges were filed. I found THAT a little surprising, since the guy was outside, trying to run away. So, “It All Depends”, but history so far is “Yes, it’s legal”, at least in Texas. It should be noted that The Castle Doctrine was passed to keep over-zealous, anti-gun district attorneys from bringing unwarranted charges, and to protect homeowners from civil suits by burglars, or families of deceased burglars. It isn’t a license to knock off your in-laws or something. If you shoot someone who has broken into Your Castle and there’s ANY reason to suspect foul play, murder WILL be suspected and investigated. For instance, if you knew the burglar a detective will start looking for any motive you might have had for murdering him. If they find a motive, you’ll start getting asked some very pointed questions…Or if he (or his dead body) had anything on it which might indicate he was there for a legitimate purpose, THAT will not go unnoticed. The fact that he works for a cable company and has some sales brochures is not going to raise any eyebrows if you shoot him at 11:00pm, but at any time during normal working hours, it will make people wonder things… very inconvenient things for you.So it’s not just a license to shoot people, it’s merely a device to protect homeowners from unwarranted legal problems if they DO shoot someone and it is a justifiable shooting.

(North Carolina Law) Is it legal to lock a 16 year old out of the house? If yes, what can be done about it?

You should call the Department of Social Services, Child Protective Services in your county. North Carolina isn’t the most progressive place in the country recently but locking a kid out of the house is beyond the pale. If the CPS people can’t straighten out your parents, they will find you a foster home. They might require some sort of counselling as well.Finding a job is generally a good thing for a teenager to do to get some work experience, but I know it might not be as easy as it seems.Edit: Maybe the culture gap between N.C. and the Northeast has grown wider than I thought. See the link in Karen Tiede’s comment. Apparently there was a “debate” there over whether leaving a nine-year-old in a park while Mom went to work was acceptable. That’s a no-brainer in my part of the country.

What are the North Carolina knife laws?

Your question was: “What are the North Carolina Life laws?”First, I Am Not A Lawyer and this is not legal advice. Do your own research. With that disclaimer, let me link you to the North Carolina General Assembly website where they store the NC State Code, where it talks about carrying illegal weapons. Please read the whole thing if you want to understand how my state thinks about this.http://www.ncga.state.nc.us/Enac...(d) This section does not apply to an ordinary pocket knife carried in a closed position. As used in this section, "ordinary pocket knife" means a small knife, designed for carrying in a pocket or purse, that has its cutting edge and point entirely enclosed by its handle, and that may not be opened by a throwing, explosive, or spring action.I regularly carried around a 4″ blade-length pocketknife (Cold Steel “Recon 1” straightedge) for the better part of 10 years there. I did not take it into court buildings, schools, or other government buildings, but I carried it everywhere else. I never handled it in a threatening way, played with it around other people or generally did anything other than leave it in my pocket until I needed to use it for whatever.I never once had a police officer question me on it, even walking around downtown Raleigh, though I did speak to them a fair bit. I always carried it with a clip that was visible on the outside of my pants pocket as well, which meant it wasn't concealed as long as I wasnt wearing a jacket, so people knew I had it.

If You Shoot Someone Below The Waist, Is The Penalty Really Less Severe?

My friend and i had an argument about this so i wanted to hear from people who might really know the answers. If you fire a gun at somebody below the waistline, examples knee or legs, that you cannot be found guilty of attempted murder because you did not aim to kill. Is this really the case that you wpuld only get an assault and battery charge and not attempted murder?

What's been the economic effect of North Carolina's anti-transgender law?

A loss of both Federal and private funds/ revenue. I reside here, and am opening a restaurant soon, so I watch these things. Its 3:39 am, Im sure someone else will quote the exact number. Paypal backed out >500 jobs lost, Red Ventures rescinded expansion plans ?> jobs lost, Bono, Mumford and Sons canceled Arena concerts, Several direct and ancillary dollars lost. For an exact figure, literally google "cancelations due to HB2" and there is a dedicated lage where you can tally up job loss, direct revenue loss and indirect revenue loss, both Governmental and Private.
