Legal Guidance Needed For Me.

What are the legal bases for guidance and counselling in the Philippine education ?

It is required by the school,
It is not immoral,
It is an exercise of academic freedom, and
It is not contrary to law.

Can I sue my guidance counselor?

Last semester at the beginning of the school year, I began to go by the name Drew. My guidance counselor, lets call her S, called me into her office and told me that I was not allowed to do that, because if there were an emergency everyone needed to know my legal name, which is all a bunch of bullshit considering that numerous other students go by nicknames only at the school. She forced me to come out to her as transgender, and when she did I told her specifically that I did not want my parents to know. She told me to stop going by Drew, which I didn't do because all of my teachers were okay with calling me that and knew my legal name in case of an emergency.
Flash forward to the new semester. I again asked my teachers to call me Drew. On the second week of the new semester, people in my class were making very rude comments about both gender and mental illness, so I sent my teacher an email, just to make her aware. The teacher went to S, because she didn't know how to handle the situation properly. S called my mother, and not only lied to her and told her that I was purposefully making comments to offend other students, but told my mother that I was trans.
Because she outted me to my parents without my knowledge or consent, is there any way for me to fight her legally? As I wasn't threatening to hurt myself or someone else, I know that a confidentiality rule was broken, but was a law?

Can a legal professional provide some vague and general guidance, not a legal opinion, on my landlord-tenant issue?

My guess is that you are trying to resolve a legal issue…Anyone CAN provide general legal advice - including any “legal professional”, paralegal, friend, co-worker, or even the bus driver that picks you up in the morning…You need to assess the risk of accepting that advice (from any of the listed parties) and the costs verses the potential losses you may have regarding the landlord-tenant issue to be resolved. Sometimes it is simply better (cheaper and faster) to negotiate and end up paying something than to let it go to court.Note: it could be that the bus driver’s “free advice” (you still need to pay the bus fare) is just as good as that of the best lawyer in town… or maybe it is not.You get what you pay for.

Can i sue my school guidance counselor?

Well basically I had a breakdown in school and was talking about what was stressing me out and whatnot and why I'm so sad. Like I'm not going to lie I do have suicidle tendencies. So my bf skipped school and came over to my house because he thought I was going to harm myself. His mother called the school. The guidance counsler told her thhat he's probably with me that part is like okay. But then he told my bfs mom that I have a "problem" and. That I don't go to school and my sisters dropped out of school. Is that legal?

Is RapidShare.com Legal?

RapidShare is legal. Some of the things you might find on there are not.

Think of it like a gun. Here in the US, depending on your background and locality, it's perfectly legal to own a gun. However, just because you can legally own one, doesn't mean you can go about shooting whoever and whatever you want with it. There are many illegal things that can be done with a gun, even if owning one is legal.

The same is true with filesharing sites like RapidShare (and P2P software). While it's perfectly legal to use RapidShare to do perfectly legal things, it's obviously illegal to use it to do illegal things (such as sharing/downloading copyrighted material, such as movies and music).

So, if what you're asking is whether RapidShare the site is legal, then the answer is, "Yes, absolutely." But if what you're asking is whether you can run about downloading and uploading whatever you please on RapidShare, then the answer is, "No, you cannot break the law with something legal just because 'using' it is legal." (See my earlier gun example)

In response to your followup, setting up a filesharing site is a dangerous thing to do without legal guidance -- and not the kind of "armchair lawyer" guidance you get from Y!A. You should consult a real-life copyright lawyer (and probably keep one on retainer) if you're going to go into the file hosting business.

The basic deal is that under the Digital Millennium Copyright Act (DMCA), a service provider is protected from litigation as long as they comply with the Act. My understanding is that this generally involves making a good faith effort to remove any copyrighted material in response to DMCA takedown notices (that rights-holders are responsible for furnishing you with). If you do not comply with these notices in a timely manner (by removing the infringing material), then you can then be subject to lawsuits. These lawsuits allow for damages up to $150,000 per "infringement" (which apparently has generally been held to be "per infringing item," but might be argued to be "per download").

Therefore, you could easily be looking at millions of dollars in damages if you don't work hard to keep in compliance with the law.

I'm not a lawyer and I don't play one on the internet. Therefore, I highly recommend you consult with someone who knows what they're talking about (a member of the Bar) and will be able to back that up in civil court.

Is it legal for a PUBLIC high school to deny a student to enter a class?

I go to public school and am being denied entry into AP English. When I asked guidance they told me my grades would not support entry. Thats the only thing holding me back, there are enough spots left for a couple more kids.

I was angered that my final determines if I am allowed to take the class. I told them "I respect your concern, however, I still would like to take it."

Because my parents are paying the school/teacher's salary shouldn't I be allowed the option?
