Can a maintenance man enter apartment without permission?

I have an eviction pending from my apartment that was stayed until yesterday in order to give me a chance to catch up on back rent (I am paying the back rent so please do not make rude or negative comments regarding that). Today a maintenance man entered my apartment without permission. I was home and I found him walking in and he told me that the property manager sent him over to see if I was still living there. The door was locked and I saw he used a key to enter. I have not been served with a warrant of eviction yet and my lease states that maintenance can enter without notice or permission in the case of an emergency or repair request, which was not the case here. What can I do about this? Should I make a police report? I live in Monroe County NY.

People are crazy that say you waived your right because you requested service. That was almost 4 weeks ago that you did that. The apartment is being very lax in their handling of this. At MINIMUM they needed to let you know the blinds were in and they would be coming sometime soon. Even that is weak. Actual notice of the day they were going to come by is standard and shows they actually care about the tenants privacy. This violates your right to a peaceful living environment which all states require.

Now, there wasn't really any malice or ill intent here. They were just lax in how they handled this. Talk to the office calmly and let them know what happened and that if there is any reason in the future for maintenance to enter that you'll expect a 24 hour notice as required by law. A written follow up is always good as well.

Can the Gas man enter premises without permission?

The gas man walked right in my side door (unlocked I didn't realize), down into my basement and read our meters WITHOUT my permission. Is that legal??? I do not answer the door when my husband isn't home for no one in case you're wondering why I didn't answer for him in the first place.

Can apartment maintenance walk in without any notice?

I had my apartment maintenance just waltz right into my apartment when I was taking a shower.

It really freaked me out because the office had not informed me of anything nor given me any notice.

In my lease it states that maintenance would be able to repair and enter into the apartments when things needed to be fixed, repaired etc.

The catch is that I had nothing wrong with my apartment but, the person living under me filed a complaint of a leak. The office did not give me any time or notice that the person living under me had this issue and would need to come into my unit for possible repairs of the leak.

I'm just really startled because I am a young female living alone and I was in the shower when these two men just helped themselves in.

Is there any way that I can prevent this? Am I able to tell the office or even have the right to tell the office that they need to at least give me notice?

to JD: maintainance men are given the keys to your apartment! I am sure her door was locked!

That being said, if it makes you feel better, I would get a latch lock that you can use to supplement your bedroom door handle. That should be allowed. Also, if its allowed, I would add a chain lock to your front door. Those locks can only be locked from the inside when someone is there. so if you are there and vulnerable, no one can get in.

I am really sorry to hear that happen and I would talk to your landlord. It does sound like a simple misunderstanding on their part,but I know how you feel. A couple of years ago when I still lived at home in an apartment I was coming back from school by myself and found the door to my moms apartmetn open and the voices of strange men inside and it scared the crap out of me. I ran outside and all the way to my neighbors and didn't go back until I knew my mom was home. I knew it was just maintainance guys but they are MEN and we are WOMEN and they should know that we would feel uncomfortable alone with strange men.

Not unless your life is in danger. If they have no weapons, you can't. They have the legal right to retrieve property.

As a tenant you should have certain street rules you live by. One of them is never let a handyman or any other contractor into your rented space unless you are there to monitor their activities. This rule should be enforced by you and coordinated with lease clause that allows landlord to gain entry for repairs. Most non-emergency repairs are scheduled events that you can arrange around your time schedule to ensure you are their to oversee work and protect your valuables from dishonest contractors.The exception to this rule is emergency repairs. In this day and age of Youtube, visible or hidden cameras are cheap to buy and are a great detterent against crime committed by a theiving landlord or contractor.In your case you have no idea who actually stole your stuff, it could have been the contractor OR a landlord with sticky fingers. Seems odd the landlord does not want to pony up info on contractor who seemingly lifted your stuff. Is he protecting the contractor from liablility or himself? At any rate video surveillance for tenants is mandatory to avoid these unsavory situations.Furthermore, tenant street rule number 3 was designed for such an event. All tenants should have renter’s insurance. Theft is a covered peril in most renter’s insurance policies. Although in your case, $100 would probably be below your deductible amount and would have to absorbed by you.So the best course of action: deduct value of items from future rental payments. If landlord complains or sues you for non-payment of rent- take it to the judge and let a higher authority decide your fate. FYI, you should file a police report as evidence of incident and get 2 witnesses to back up your claim of valid ownership of items. If you have receipts for items retain them as evidence in case this matter becomes litigous. Most experienced landlords would avoid this fate by confirming tenant is home during any scheduled repair jobs.

No, Owner can’t enter the house you rented without your permission. After permission he/she obviously can but there are some possible situations and conditions you can say, Like if owner want to visit, then he can do it after a prior notice and with proper reason or purpose may be like maintenance, some improvement work or can show the house to prospective tenants or buyer.Also you can specify some clear points in contract, specified visiting hours, visit purposes and situations like repair or some other emergency works and notice period for visit.

Harassment from apartment complex maintenance man?

In my apartment complex their are hired maintenance men who do repairs and other tasks, but to do repairs they have to enter my apartment or who ever's apartment. But this particular maintenance man who enetered my apartment a week ago is now spreading rumors and revealing things to my neighbors. I've asked my neighbors what time the maintenance man was talking to them about me, and it was around 5:00pm, which is part of their work hours. What I'm asking is can I do anything about this, and if I can, what should I do?
There is a company office located in the complex that I can always go to.

Depends who it was.

A private "repo man" cannot enter your property without your permission. A sheriff's deputy or court bailiff, however, can if they are serving a court order of possession.

BUT.... you may have given permission, and not realized it. Was this a washer/drier you were buying, or renting through a Rent-a-Center? It's VERY common for rental agreements to include language in the small print giving them permission to enter your property to get your stuff back.
