I rent to a Section 8 tenant; who is responsible for pest control?

I have a section 8 tenant with a rental agreement that was approved by the city. It clearly states in the rental agreement:

3.MAINTENANCE AND REPAIR; RULES. Tenant will, at its sole expense, keep and maintain the Premises and appurtenances in good and sanitary condition and repair during the term of this Agreement and any renewal thereof.

I received a call today from the tenant, who moved in 7 months ago. She was upset because approx. 1 week ago her son saw a mouse (she said rat, but I think mouse; I asked to clarify, she said she wasn't sure) in the house and they have found droppings in his bedroom closet and in the kitchen.

My advice to her was to keep all food contained to fridge/cabinets, not allowed into bedrooms. Set traps and bait them in the areas there appears to be a problem. She has two children (7 and 8, I believe). I told her I don't recommend mouse poison, but if she believes her kids are old enough to know to stay away from it then that is an option for her. She was very upset at this new problem, but I don't feel like it's my responsibility because she didn't move in with mice in the house. The rental agreement states she must maintain the property. Who would be responsible for an exterminator if one needed to be hired? I did tell her to give it a week after setting the traps and update me.

How do you effectively inspect for bed bugs within 24 hours of signing the lease to an apartment/house if the place will be cleaned & painted prior to move-in? After 24 hours, am I really at fault if I find one?

I’d like to know more please. Why are you concerned in the first place? Did you have bedbugs before? Did the previous tenants? The only way I know of is by looking at your mattress for an already occurring infestation (red or brown blood spots) and bites from them, if the apt. is and has been empty, they have nothing to eat so they will move to the apt. next door or the nearest place with bodies, only to come back once your moved in. An infestation would not happen immediately if all bedbugs were out, but pretty quick if they are still there. If any other apt. in the building has, or ever had bedbugs, I would confidently say they aren’t your fault. And unless you are high risk for them, I would also say they weren’t your fault. Bedbugs will usually infest more than one apt. in a complex that is connected, so ask neighbors maybe? Also, depending on where you live, there are tenant/landlord laws about who is responsible for infestations.FYI bedbugs can live for up to two years without feeding.

There are frogs, spiders, geckos, and cockroaches in my house!!?

It's not infested. Generally there's like three little pee frogs hopping around a day, maybe every 2 weeks ill see a baby gecko or two, there are ALOT of spiders, and yesterday I saw a baby cockroach in my bathroom and I have never seen a cockroach in my house until yesterday and I've lived here for 17 years. I clean my house everyday and I have a fireplace but the hole where the smoke goes out has a cover so they aren't getting in through there. I don't have time for someone to bomb my house because I think you have to stay out of it for a day or two and I have work and nowhere to stay. So is there any canned pest spray that will get rid of them? I HATE creepy crawling bugs and frogs and lizards. Help!?

Does my landlord have to provide a garage door opener?

My landlord refuses to provide a garage door opener. The management company is telling me that I can buy my own opener and reprogram it. I think that my safety is being compromised. I have no way of knowing if the previous tenant bought a garage door opener. If he/she did, then they can access my home. Shouldn't the landlord have to provide a garage door opener at his expense?

Can I get out of a lease for breach of contract?

My current landlords are less than desirable. They refuse to pay for pest care (even though it is not in the lease that we are required to do so), when our refrigerator broke 3 months after moving in and we lost 250 worth of groceries, they waited 3 days to replace it (and obviously didn't knock anything off the rent to account for groceries), and our air conditioner has broken twice in the two years we've lived here, once in each August month.

The AC is the biggest issue. On both occasions, we realized the AC wasn't working on early Friday afternoon and contacted the Landlords immediately. They didn't want to pay the emergency fee for someone to come out, so they made us wait until late Monday night to have it fixed. We live in Central Texas so we are talking about 102 degree temperatures in the middle of August.

I have a 10 year old English bulldog on the premises which i had to keep in an ice bath for almost 3 days because she can die in temperatures over 85 or so from overheating (bulldogs are a finicky breed and she has actually flat lined before from swallowing her tongue when overheating approximately 5 years ago). I realize this would not be important to a good deal of people, but I am paying good money to rent this duplex and my pets are on file with paid deposits. Our deposit was 1300 dollars and between the two units, the landlords are pulling in 1800 dollars in rent for a duplex that cannot have a mortgage higher than 800 or so a month. I am naturally wondering why it is they cant dish out the extra couple hundred dollars to have the AC fixed within a day. They are also unwilling to use a company other than the current one who services the AC, but that company does not have an emergency pager/phone number, at least not one that they answer.

This year around I am pregnant and will naturally be very frustrated if the AC goes out again in the middle of August (which im sure it will because they have yet to have the unit replaced and it already seems like it is losing some steam in light of the summer heat). My question is if this happens again, can I get out of my lease for breach of contract because the landlords fail to maintain a livable environment? I feel that requesting/forcing us to live in 102 degree heat (it actually gets hotter inside if you can believe that) for 72+ hours to save them 125 dollars is unreasonable and irresponsible.

How easy is it to hide a cat in your apartment?

Wow that insane you are expected to pay that for a cat! I'm not sure what country you are from so this may not apply to you but landlords can not enter your property (well theirs lol) with out giving you two weeks written notice of the inspection. If they do just surprisingly come to your home you have every right to reject them entry to your premises. As for the cat situation. Cats love to sit on window sills... Well mine does so that could mean anyone can see the cat including your landlord if they decided to drive past your apartment one day. I wouldn't risk it as you don't want to get a cat.. get attached then your landlord finds out then either the cat has to go or you both do. But if your willing to take the risk... You can try and hide the cat..Not during an inspection unless you want meowing in the cupboard the whole time now that one.. I don't know how you will explain lol. It would have to go to a friends house during the time your landlord was over. Also cats can smell especially if you got a male then can spray everywhere which would mean airing your apartment out for a day or two before the inspection and hiding anything cat related.. Litter box, cat food, toys, scratching pole everything. They can also do a lot of damage like ruining carpet, screen doors, scratching doors etc. I honestly do not think all of that is worth it... Pay the fee's so you and puss can live in peace :D
