Quiz - What Is Impeachment Really Mean

How was the impeachment of Andrew Johnson a test of the Constitution's system of checks and balance?

Jackson's impeachment was done by the House, and was voted on in the Senate. He was impeached for not following the plans that Congress wanted for Reconstruction. He also fired one of his cabinet members, which there was an law against (this law was later stuck down as unconstitutional).

By having a bicameral legislation (2 parts Senate and the House), the balance of government is both for the larger states, and the smaller sates. It was also a check that one part of the legislative branch cannot easily remove a seating president.

AND YES THERE WERE 2 PRESIDENTS IMPEACHED- To be impeached means that the house brings charges against the president, so the Senate can vote for removal. That means there are 2 steps to remove a president, the first is impeachment.

Did president Richard Nixon resign, or was he impeached?

A few days before he resigned, a House committee found proof that Nixon had paid money to the Watergate burglars to keep them quiet, and that he had ordered the CIA to keep FBI from investigating him and his staff.

This made it absolutely certain that he would be impeached (similar to being indicted) by the House and tried and convicted by the Senate. A number of his former supporters called on him to explain this to him over the next few days.

Facing this certainty, he resigned to avoid impeachment and trial. He was not ever formally impeached or tried, however.

Both Andrew Johnson and Bill Clinton were formally impeached, and both were tried and acquitted. No U.S. president has ever been impeached, tried, and found guilty.

What is the meaning of the statement " Ethics is larger than the law"?

Many people and businesses behave unethically, but stay within the law. The law is not always fair because it deals strictly in interpreting objective facts whereas ethics takes into account the fairness, the equity, in a situation. Sadly, this difference between the actual law and ethics allows unscrupulous people to get away with egregiously bad conduct.

Ethics is larger than the law because it includes both the objective and subjective aspects of a situation and thus holds conduct to a higher standard than law alone. Ethical behavior is really a matter of good conscience.
