How do I sell my gun/pistol legally to another person?

Yes, in most states its PERFECTLY LEGAL to do a private sale.
All thats required is age verification, and that you are selling to someone who appears to be of Reasonable Morals/Judgement.....as long as they dont appear to be insane or drug/alcohol abuser.

But for private sale, no paperwork required, just cash and carry.
But YES the gun is still registered to YOU, HOWEVER most states DONT require that you report firearms that were Stolen or Sold....UNLESS it is a Class 3 regulated firearm or device(fully automatic weapons,silencer, destructive devices, and pistol stocks, sawed off shotguns, street sweepers,etc...)

Even in some of the most strict gun states, like maryland, new jersey,etc....there is no law stating you must notify police when a firearm is sold or stolen.


Just for scenario lets do this....

-Say the guy you sold your pistol to turns around and kills someone.
Now police are SUPPOSED to delete firearms transaction/registration records after X-amount of months or Years......but they probably dont.

So the police found your gun, or shell casing matching your gun.
You just state that you either sold the gun, or it was stolen, and that there is no law requiring you to report sold or stolen firearms.
There is legally nothing they can do except interrogate you...

Although its DEFINATELY a good idea to report a stolen gun!!!
Because it could lead to more trouble later on if the gun is used in a crime.

Selling a gun private party?

Here is the law for Indiana.~
Rifles and Shotguns

Permit to purchase rifles and shotguns? No.
Registration of rifles and shotguns? No.
Licensing of owners of rifles and shotguns? No.
Permit to carry rifles and shotguns? No.

Handguns

Permit to purchase handgun? No.
Registration of handguns? No.
Licensing of owners of handguns? No.
Permit to carry handguns? Yes.

Purchase:

It is generally unlawful to sell or transfer possession of a handgun to a person under 18 except if the gun comes from the juvenile's parent or guardian.

It is unlawful for any person to sell or give a firearm to any person whom he has a reasonable cause to believe has been convicted of a felony, a drug abuser or under the influence of a drug, an alcohol abuser or in a state of intoxication, or is mentally incompetent.

The regulation of the sale of handguns shall apply equally to the occasional sale, trade, or transfer between individual persons and to retail transactions between dealers and individual persons. ~

How do I legally sell my personal guns in WV?

I have sold some of my extra guns on www.auctionarms.com

1. Register to use the site to sell your guns, it is free.

2. Search the site for guns like the ones you want to sell, that will give you an idea of what to ask for yours.

3. Take some good quality photos of your guns on a digital camera.

4. Posting the weapons for sale on the web site is a fairly straight forward process. Just a little tricky getting photos loaded, but not that hard.

5. Describe your weapons fairly.

6. Auctionarms will charge you a 2 1/2 percent sales commission on your sale, which is dirt cheap.

7. When you look at other guns for sale you will note that all of them ask the buyer to send a signed copy of a dealer's FFL. You have to do the same.

8. Once someone has won your auction they will send you the purchase price (money order) PLUS shipping charges, and the FFL. Once you get the money and the FFL you then ship or mail the gun to the FFL dealer. That dealer, when he gets your gun will have the new owner fill out the necessary federal paperwork and transfer the gun to him.

Having a local dealer sell the guns on consignment for you will generally cost you a 10% commission.

Recently I sold off one of my Ruger .45 LC Vaquero revolvers. Once I got the buyer's money order and FFL, I packaged the gun in one of those U.S. Post Office boxes that you can mail everything for $10 in, and mailed it to the FFL dealer.

And, Yes, that is prefectly legal. As long as the gun is going to a FFL dealer, you can mail a gun.

You won't be able to mail a rifle, generally too long. I'd advise asking your local dealer to ship the gun for you. Some of them have deals worked out with shippers for better rates.

None. I identify with no political party, and I never will. Ever.Political parties come with a lot of commitment and harsh realities. If you support a party you, by default, condone everything the party does. Democrats, Republicans, Green, or libertarian. How old do you have to be to SELL a gun?

Yes, you are legal. There is no prohibition on anyone 18 and up owning or handling hand guns. You just can't buy one from a licensed dealer but you may buy one from a private party or accept one as a gift. You may absolutely buy and sell as an agent (employee) of a dealer. In fact you may even do that as a juvenile (under 18).

The shop where you're working should have a couple of books on hand that you should look at whenever you get a chance. They'll answer a lot of questions you might have. My dad just died. Where can I sell his guns?

My father just passed away last month. He owned three guns that he never even used once, a rifle, a shotgun, and a handgun. I am not interested in keeping them. What is the best, easiest, fastest legal way to sell these guns, hopefully without getting TOO ripped off? What is the situation with using a Pawn Shop? Worthwhile? I kinda wanna make some money before Thanksgiving, so I am considering that route. Also, what are the legal issues or what sort of papers do I need to make sure are there when I sell, if any, and will it no longer be registered in my dad's name if I use a Pawn Shop? I know nothing of this stuff, so any help would be great. I'd like to hear any suggestions, but would prefer something timely rather than waiting for a gun show, and something definitely nice and legal in the clearest way possible. Do I need to contact anyone official before doing this, like the police or something? Thanks again. I am located in TX, if that's an issue.

How can I sell an unregistered gun?

If it is a civilian version that only does semi-auto, then it isn't an M-16. What you have is an AR-15 and it is perfectly legal to sell it. Who is it made by? It wasn't your grandfathers service rifle was it? If it was made by Colt or Armalite then it could possibly be an actual M-16 but even these companies have made civilian versions. It could be a firearm that he converted to a civilian rifle but I think it is probably one that he bought from a private sale and it is just another AR-15. If this is the case, put an ad in the paper or something like "american classifieds" and just have someone pay cash for it. It is perfectly legal to own or sell a gun that is not registered. Only an FFL dealer at a gunshop has to call it into the BATFE to get it registered. Every private sale is a person selling an unregistered or registered gun to another person. The buyer does not have to get it registered, unless there is a stupid state law that requires it, but that is only a few states. The guys above me are idiots. It is not illegal to sell it and it is not arms trafficking. Just check your state laws to see if there are any regulations on private sales. You could also go to a gunshop and see if they do consignments, which means they will sell it for you, take a percentage, and then it will be registered to someone else. However, if it is a true M-16, it could get hairy. We really need to be clear on if it is a conversion or just an AR-15. The later could be sold for cash from your house and it wouldn't matter one way or the other. PERFECTLY LEGAL in the US of A!
