Someone Hit Me But They Were Injured And Now Want Me To Pay Their Medical Bills. Help

Geico is only going to cover 1,000 of my medical bills and says im responsible for pursuing the other insurance company is this right?

I was involved in a 5 car accident as a result of a car spinning out at high speeds on the highway and coming towards oncoming traffic that was driving at 60mph.
My car took a hard hit and I was taken by ambulance to the ER. I'm certain this ambulance ride alone cost $1,000.
The details of the accident are still not available and no police report currently 5 days out from accident. I don't know the names of the other drivers or the person who caused the accident because I was taken immediately to the ambulance and didnt have time to talk to anyone or take photos because I was injured.
Geico is telling me that I wont get any personal injury protection because its not available in my state, no coverage for lost wages from missing work, no one to pay the hospital bills or copays and I'll need to pay all of that upfront or payment plan or risk it going to collections because if the other cars insurance company pays it will be at the end of all of my treatments including physical therapy/follow ups and their insurance wont pay the bills as they come in which means they're at high risk for going to collections......
How come my own insurance company isnt going to fight for me and get the other insurance company to pay my medical bills when they're at fault? Isnt that their responsibility? They are even telling me that I'm responsible for getting the police report and uploading it to their app. Geico is screwing me......

I got in a hit and run accident and the insurence company stated I was not at fault. I only have liability?

I work for a personal injury firm in NJ. This is a no-fault state. So this is how it works....First, every person whether they have full coverage or just liability, has Uninsured Motorist Coverage. Which will apply to your cases. In order for your car to get fixed, you have to open up an uninsured motorist property damage claim. You have a deductible, which will apply to this. So they'll deduct the deductible from the total due to your car.

Second....if your friends are injured, they have to go through their households insurance company. So if they don't have their own insurance, they would have to go through their parents or siblings car insurance. In the event that there is no car insurance in their households, they would go through yours. This type of coverage is called PIP. Its for all medical bills.

If they are hurt and want to sue, they might have to sue your Uninsured Motorist Coverage, however, due to the fact that you weren't at fault, its possible that your friends might have to sue their own household insurance company because its likely that your insurance company will deny their bodily injury claims. If you are hurt, you can sue, as well.

Just a reminder....here in NJ, a copay and deductible does apply. The standard is $250.00 deductible and 20% of the first $5,000.00 billed. So if you do the math, its about $1,250.00, which comes out of your pocket.

Don't take it personal if your friends sue you. They are not suing you personally, they are suing your insurance.


And no you are not out of luck for Uninsured Motorist Coverage, trust me, you are entitled to it. If you need any help, just ask.

Uninsured driver hit me, what can I do?

last night I still didn’t sleep, and when I do I have nightmares of the accident. My fiancé’ didn’t get hurt but he has images as well so he is going to doctor to help him rest to. We both saw the person be ejected out of the vehicle and fly in front of our car. It’s horrible. If someone refuse to be seen by EMS on a scene of an accident?

Yes, he can sue you later for his injuries, even though he refused treatment at the scene. It happens all the time.

Did you call your insurance company and file a claim? If not, do so asap.

Your insurance company will determine if you are liable or not to the biker. If not, they will deny the claim, and if you are responsible, they will pay him.

Auto accident other insurance company wants me to sign a release?

I have this question in to my insurance company also, but it always takes longer to get a response. I was in an accident in May in Washington state. There was no police report filed because the accident happened out of cell phone coverage areas. The other driver is fighting the at fault even though he hit me on my passenger side while trying to pass me over a double yellow line while i was turning. The case is beyond the insurance now and fault is being decided.
I had about $1000 worth of damage to my car, but my husband and I both have had to go to chiropractic care since. I recently stopped though since I don't want to deal with an attorney.
The other insurance company has been trying to get me to sign release papers and get updates on my medical information. I told them today I am not telling them anything, they can talk to my insurance. Are they being shady? Or do they have the right to push for my information? Isn't that why I pay my insurance?
