the short, fast answer to your question is likely: YES! the more detailed answer is: no, the government does not own the first five feet of your property, you do. the catch is that you likley think your property starts before it actually does.  in most municipalities in north america there is a 'road allowance', which is owned by the municipality. the actual road might be, say, only 20 feet wide, but the legal road allowance, owned by the city, could be, say, 30 feet wide, meaning that the first 5 feet of grass on your front lawn is not actually yours; and never was. it's most likely that your actual property line starts a fair distance back from the road or sidewalk. so the city does not own the first 5 feet of your yard, you just think your yard starts 5 feet before it actually does! (your survey could help you determine the exact property line).
