Unemployment Bebefits Paid For Two Months Now They File An Appeal

Appeal for Unemployment Benefits?

So I went to court for my Unemployment Benefits and they said i wasn't allowed to receive them due to the fact that what i was fired for which was driving a car with a dealer plate in the back window was illegal. I forgot to tell the judge that my boss said that it was okay to do that. So now i have to take one of the following actions, request for rehearing/reopening to the Administrative Law Judge, File a writen appeal to the Board of Review, or file a direct appeal to circuit court. I'm strapped for cash hence unemployment and can't really afford an attorney. I asked for a postponement but i was told no at the hearing. I told them i needed more time to seek council. So any advice i'm all ears, i'd like to do something soon, considering it has to be in on or before may 22, 2009. Thanks for any assistance.

CAN I STILL FILE FOR PAYMENT OF UNEMPLOYMENT BENEFITS, 3 MONTHS AFTER I FILED AND AM NOW WORKING?

3 MONTHS AGO I FILED FOR UNEMPLOYMENT. EDD INITIALY MADE A MISTAKE ON MY CLAIM AND DENIED BENEFITS. TWO MONTHS AFTER MY APPEAL, I RECIEVED A WRITTEN LETTER OF BENEFITS APPROVAL. I AM NOW WORKING AND IT HAS BEEN 3 MONTHS SINCE I FILED. CAN I STILL SEND IN MY CLAIM FORMS FOR PAYMENT? AND WILL I GET PAID? OR IS IT USELESS FOR ME TO SUBMIT AFTER 3 MONTHS?

Your spouse would desire to have got here upon a sparkling interest ahead of quitting. Letters from a physician mean no longer something. a individual who mandatory a paycheck could have persevered working till he/she ought to discover yet another source of earnings. Ohio Unemployment Benefits Appeals Process?

My husband and several of his co-workers were laid off in October after 3 years with his company. They were given 1 month's severance and were told at the time they were pink slipped that they could file for unemployment. As soon as it was possible, he filed for benefits. About 2 weeks later, we received a notice in the mail that his request for benefits was denied because his former employer is appealing, stating that he was not let go for 'reasons beyond his control'.

We have spoken to a few other employees that were eliminated in the same round of layoffs that my husband was let go in. At least 2 other people were also denied benefits pending appeals but a few others were allowed their benefits as the company chose not to appeal those benefit applications.

My husband had a running conflict with a manager about a year before he was laid off. It went before HR and the manager was reassigned to a different business unit as a way of defusing the situation. I'm guessing that that the company is using this prior situation as their basis for stating that his elimination was within his control, the subtext being if he had avoided being insubordinate to a superior then he would have eventual kept his job. But really, I have no way of knowing.

Because my husband had "an HR file" - how likely is it that he is likely to win his appeal? We just moved here from Florida a few years ago where the unemployment guidelines are much different so I'm not sure how realistic our chances are of winning our appeal.

I was denied unemployment, should I file another appeal?

I had a telephone hearing a couple weeks ago and was denied unemployment benefits. I was pregnant and my employer made me go on maternity leave at 7 months. They made up a policy 2 days after I was put on leave stating that all pregnant employees have to go on leave at 6 months pregnant. I was denied because of this policy. Any ways, I received a call from one of my co-workers that was also placed on maternity leave by our employer, she was approved for the benefits. No fights, no appealing, no nothing. Why did she get approved and I didn't? We were both on leave for the same thing!! So should I re-appeal it? Or just let it go. She was 5 months when she was put on leave if that makes a difference. I have not been back to work there, when my 6 weeks was up, I spent the next week in the hospital with a sick child. My employer, the owner, claimed that I never attempted to go back. I did, when I picked up my W2 my son was 4 weeks old and I told my manager on my shift I was wanting to come back after I got my doctors release. So in the hearing the owner told the judge that they had to fill the position since I have been gone since October. They are the ones who made me leave! It's a bunch of B.S!

No, you apply for unemployment for the first week you are not working.  After you get a job, than you are getting paid for working that week.  The wait is due to the paperwork and all the t's having to be crossed and all the information being verified.  You don't have the right to be getting unemployment for the month that you are working.

Since this is tagged for Texas, I will answer that in Texas, no you cannot receive unemployment benefits unless you A) have prior employment in the state  B) were separated from employment for a reason that qualifies you to receive benefits and C) meet ongoing eligibility requirements.A) Since you never had a job you don't qualify under the first conditionB) Qualifying work separation includeslayoff reduction in hours or wages not related to misconductbeing fired for reasons other than misconduct, or quitting with good cause related to workC)Ongoing eligibility includes:Meet all work search requirements, unless we exempt you from work searchRequest payment for weeks of unemployment, when scheduledBe physically and mentally able to workBe available for full-time workParticipate in reemployment activities as requiredRespond to requests from TWC or a Workforce Solutions office as instructed

How long does it take to collect unemployment benefits in NY after winning appeals hearing?

I even have viewed unemployment appeals a year or so from the actual date of the award of the money to the worker the fact the agency did no longer retract on a well timed bases or became into gradual to react is going to have little bases on the attraction listening to its self, in the event that they're granted the attraction you could attempt an argue on the listening to they did no longer well timed respond, yet whilst the examiner shall we the attraction circulate forward then you certainly've got subjects at the same time with your leaving the business enterprise it must be voluntary provide up meaning a non-fraud refund could be due and owing via you for the monies paid out

I lost my unemployment appeal hearing, do I have to pay the money back?

You aren't required to have a lawyer for an unemployment hearing. Do you have proof of your attempts to find alternate transportation? What was your previous transportation if your original residence didn't have access to public transportation. Could you walk to transportation? When you moved, why didn't you make sure you had access to transportation? Quite honestly, you might have trouble qualifying for unemployment unless you've moved again to an area with public transportation. If you still don't have reliable access to transportation, you won't qualify because you wouldn't have the means to accept a job. Good luck to you... hearings can be frustrating. Make sure that you have proof of the attempts that you made to secure transportation... this is going to be your key to getting benefits. In addition, make sure that you show the transportation now available to you -- this will also be required. You don't need a lawyer, you'll just need all of the proof you can get.
