Will I get time in jail for a first offense misdemeanor?

You might.  The likelihood is these charges were filed by detectives following an investigation.   I would imagine that they believe there was some threatening or harassing behavior involved.   If there is a domestic dispute, previous domestic violence issues or restraining orders issued in relation to the Complaining witness, that presents additional problems.  If that's the case, the state is going to want some assurance, at minimum, that the complaining witness will be not be further threatened.   If there is some doubt about this, they may definitely ask for jail time.You really need to speak with an attorney prior to any conversations with the Police or Prosecutors.  You have to hire an attorney.  If you have no money, contact the Legal Aid Society or Public Defender in city in which you were charged.

Virginia first offense DUI, clean record?

I'm a girl, 22 years old with a clean record, no speeding tickets or anything. then I got pulled over and blew a .21 and got a first offense dui. I have a lawyer. I know the mandatory jail time is ten days for VA , but can the lawyer knock that off or lower it?? And does VA jail do day for day in jail? I've heard ten days would technically be five. I made a huge mistake and if you can't say anything nice then don't comment please. I've learned my lesson.

OK, I will make it simple. No smart *** answers, just the truth please. I just recently obtained a dui. Not good, I know. Lets say I leave the state and neglect going to court and get a license in another state. Now, can the state legally take my license on a charge and not a conviction? Also, if I left the country could I get retain a license in another country? Please help, anyone that knows laws and not cops, cause I do not want to hear your ignorant judgment.

I guess it depends on your state. In PA, the first offense DUI is a mandatory 72 hours jail time. Unless you are eligible for the ARD program (first time offenders program) Also, did you get in an accident? If not, then they are usually easier on you.

You usually don't get jail time with a first-time DUI. You will, however, if found guilty, leave a significant chunk of cash with the court, possibly have to listen to a judge chew you out and get to pay your insurance company steeply increased rates. A first DUI also leads to significantly steeper penalties for a second DUI within a certain amount of time. And, a DUI can be a bar to some jobs as some employers are less likely to hire someone with a DUI. You may also have to attend a DUI school with a first DUI.

I would offer to go to DUI school and pay a large fine for whatever charge that underlies the DUI charge. In communicating with the prosecutor, I would stress your clean driving record and note that this is something that you don't normally do. These are things that an attorney can do for you, but you can also do for yourself. Often times, a prosecutor is willing to take a plea on a lesser charge because he knows he will get a guilty plea on that charge and he could lose even an "open and shut" case in court (e.g. a bird in hand is worth two in the bush).

First DUI and no drivers license minimum jail time?

i have a clean recored but the night before new years, i got my first DUI and i didnt have a drivers license. i blew a 0.14 alcohol level and spent one night in jail then made bond. i have court february 1st. whats the minimum amount of time i will spend in jail? i live in colorado. i dont care about the fines, just jail time. i do not have anything else bad on my record at all. this DUI and no valid drivers license will the the first. not to mention the legal limit is 0.08 and i blew a 0.14, not very high. so please anyone with experiance or if you are a cop lol, whats the minimum jail time?

The answer is no. You're not likely to get jail time. Especially since it is your first offense. The more likely scenario is that you will receive probation or community service and be ordered to pay the money back.

First time offenders that committed a non violent crime and have no past criminal history will most likely get a suspended sentence, probation and fines.  Suspended means you don't have to serve the jail time as long as you do your probation and pay the fines.  If you screw up, you will be put in jail to serve the original sentence.
