Tiny Tim Toy Company(TTT) entered into a contract with the manufacturing firm Charles, Dickens, and Scrooge(C, D&S) to purchase Christmas toys. The shipment was due to arrive on September 1st, in time for the Christmas sales. By August 15th, after hearing from the other toy companies that C,D&S were falling behind on meeting delivery dates, TTT wrote a letter demanding assurances that the goods would arrive as scheduled. The only response they received was a letter on C, D&S letterhead that said, “Bah Humbug! You’ll get the shipment by November 1st.” Discuss TTT’s possible remedies at this point.

I am so lost, I don't necessarily need the answer but if someone could lead me in the right direction it would be greatly appreciated.

Overcoming the fear of public speaking is a topic in which most, if not all, of your audience will appreciate. Any ideas you can offer to them will be well received. You might begin by telling them that voice and clarity are important. One way to achieve clarity is to emphasize the last sound of each word. It may sound odd at first but not to the audience. It will sound very polished. This cannot be stressed enough….pause! No more than six (6) words…at a timewithout a pause. Even less….than six….will be effective. All great speakers….pause. Use a full voice. Think of great speakers….Paul Harvey, Kennedy, Reagan, Clinton, Obama….all utilized a full voice….and paused.I would not write a presentation. You might try writing on index cards some keys words pertaining to each aspect if your presentation. TALK about each word. The main thing professional speakers are doing now is telling stories. If you can tell a story about each word/topic on your cards, your speech will have a better flow.Too, after you written all the words on index cards, try to think of an acronym/word and use that to keep your presentation in order. For example, you may have written on an index card: risk, objectivity, pessimistic, neutral, encouragement and self. Think of the first letter in each word and arrange them to PERSON….or any other word of your choosing.Use PERSON to keep you on track:P - pessimisticE - encouragementR - riskS - selfO - objectivityN - neutralPractice what you will say about each word. NOTE: you are using this to keep you on track, but the audience has no clue. They will just think you are THAT good! You will leave them wanting more!To learn how I overcame the fear of speaking in public, read the ebook on Amazon Kindle - Rise Above: Conquering Adversities. It’s also available online in paperback format. To view click on the link below:Rise Above

Can you help with Business Law?

26. No, because there is no indication that the dealership refused to honor its promise, therefore no "evidence" is necessary until there is a dispute. The question didn't say they refused. -- or --

Yes, because the contract is void for fraudulent inducement, where the salesperson misrepresented a material element of the agreement and thus induced Vicki to enter the deal under false pretenses. NOTHING in (or not in) the contract matters. She sues in fraud, not in contract. Alternatively, to avoid going to prison for fraud, the dealer could offer to simply amend the contract to include what may have been unintentionally omitted under a "scivener's error".

29. Ted and Alice are going to prison for credit fraud, having disposed of encumbered collateral.

Business law?

It isn't illegal it is actually ok from time to time. The tax many always gets his money. If a person wished to take their taxes out of a different account or pay them from some other means, it is ok. This system is used for your benefit so that your taxes are taken out a little at a time. The other issue is if you are poor and you aren't going to have to pay taxes in the end, this way you don't have to bother with extra paper work. Your wages are always generally reported with your social security number especially if you are recieveing federal/local foodstamps, assistance. They put a flag on your SSN. Things always come around it isn't unethical, it would be unethical to than not pay your taxes at the end.

Business law help please!?

The Title VII threshold for employee numerosity is 15 employees. P.A.C. has more than 15, so yes, it would be subject to federal anti-discrimination laws.

They cannot illegally discriminate based upon: Race, Sex, Pregnancy, Religion, National origin, Disability, Age (over 40), and several other specific categories of protected citizens. Note that there ARE many legal ways to use these same factors to discriminate in a "reasonable manner", such as hiring only orthodox members of a religion to perform services within the holy places, or excluding women from certain types of military combat units.

Like other employers, P.A.C. should avoid recruiting or interviewing that appears to identify anyone by a protected class, such as asking, "So, you don't speak English very well, where are you from?"

A three-year-old child turned on the hot water in a bathtub. His eleven-month old sister climbed into the tub and was severely burned from the hot water (which was estimated to be 140 - 155°) before being rescued by her mother. The child died from the bums. The mother sued the hot water tank maker for having a thermostat that allowed the water to reach 170 degrees, which was the industry standard. The district court’s granted the defendants’ motion for judgment as a matter of law. The mother appealed. How should the appellate court rule?

Lofton Jackson, a police officer, was called to the emergency room of the university’s hospital to help subdue an unruly patient. Prior to Jackson’s arrival, the patient had informed the doctors and nurses in the emergency room that he was infected with acquired im¬mune deficiency syndrome (AIDS). While Jackson assisted medical personnel in re¬straining the patient, the patient bit Jackson on the forearm. The patient had previously bitten himself, and his blood was in and around his mouth when he bit Jackson. On pre¬vious occasions the officer had assisted in restraining AIDS patients, but it was always the hospital’s procedure to inform him that these patients were infected with AIDS so that proper precautions could be taken. The hospital did not warn of the patient’s condition on this night and although Jackson eventually tested negative for AIDS, he claimed that he suffered severe emotional distress that caused him sleeplessness, loss of appetite, and headaches for which he was under treatment by a physician. Because of the AIDS exposure—he was shunned by his family and co-workers and gener¬ally felt like a social outcast with an uncertain future. How should the court decide in his suit against the hospital for negligence?
